A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, APPROVING A VARIANCE RELAXING THE DEVELOPMENT
REQUIREMENTS OF THE SEWARD ZONING CODE TO ALLOW FOR
CONSTRUCTION OF A SINGLE FAMILY RESIDENCE ON LOTS 9A AND lOA, PARK
PLACE SUBDIVISION
WHEREAS, upon purchase from Dale Lindsey of Lots 9A and lOA, Park Place
Subdivision, the applicant, Mark Fortune, proposes to construct a single family residence; and
WHEREAS, Mr. Fortune has requested a Variance from the minimum buildable lot size
and 20 foot front yard setback requirements of the Seward Zoning Code.
WHEREAS, a duly advertised public hearing meeting the requirements set forth in ~
15.01.040 of the Seward Zoning Code was held by the Planning and Zoning Commission on July
5, 1995.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Planning and Zoning Commission has made the following Findings of Fact
based on the applicant's request:
1. The proposed use is consistent with the purpose of the Seward Zoning Code and the
purpose of the Urban Residential zoning district.
2. The value of adjoining property will not be significantly impaired by the proposed use.
3. The proposed use is in harmony with the Seward Comprehensive Plan for this area of
town.
4. Public services and facilities are adequate to serve the proposed site.
5. The proposed use will not be harmful to the public safety, health or welfare.
6. The topographical features of the property create special conditions and circumstances
which are peculiar to the land and these special conditions have not been caused by actions of the
applicant.
7. Financial hardship or inconvenience is not the reason for granting the requested
vanance.
8. Other nonconforming land use or structures within the district have not been considered
as grounds for granting the requested variance.

9. The applicant's request to reduce the front yard setback to 10 feet and allow the
construction of a single family residence on less than the required buildable area is the minimum
variance necessary to permit the reasonable use of the land.
10. The requested variance will not permit a land use in the Urban Residential district
which is otherwise prohibited.
Section 2. Based on those Findings of Fact, the Planning and Zoning Commission hereby
authorizes the City Clerk to issue the applicant a variance permit for Lots 9A and lOA, Park Place
Subdivision, to reduce the front yard setback to 10 feet and allow for the construction of a single
family residence on a parcel which fails to meet the minimum buildable lot size, subject to the
following conditions:
1. The owner of the property shall provide the required off street parking in
conformance with the Seward Zoning Code by designating two parking spaces
within the first floor garage.
2. Prior to construction, the process of vacating the interior lot lines of Lots 9A and
lOA shall be initiated with the City of Seward.
3. In accordance with the Development Requirements of the Seward Zoning Code,
(SCC ~ 15.10.220) the building height shall not exceed 34 feet and the total lot
coverage shall not exceed 40% (2,400 SF).
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 5th
day of July, 1995.
