RESOLUTION NO. 97-02
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, GRANTING A CONDITIONAL USE PERMIT TO DIANE CARLSON-
BENCARDINO FOR THE TRI-PLEX LOCATED AT 1103 SECOND A VENUE ON LOT
19A, BLOCK 11, LAUBNER ADDITION, GORESON-CARLSON REPLAT
WHEREAS, Diane Carlson-Bencardino requested a Conditional Use Permit for the tri-
plex located at 1103 Second Avenue on Lot 19A, Block 11, Laubner Addition, Goreson-Carlson
Replat; and
WHEREAS, an application meeting the requirements of Section 15.10.320 (B), was
submitted and received on December 19, 1996; and
WHEREAS, this request is located on land that is designated Urban Residential by the
Land Use Plan and Zoning; and
WHEREAS, in accordance with the Land Uses Allowed Table (15.10.225), multi-family
dwellings are permitted within the Urban Residential Zoning District by Conditional Use Permit;
and
WHEREAS, a duly advertised public hearing, meeting the requirements of Section
15.01.040 was held by the Commission on January 10, 1997.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. In accordance with SCC ~ 15.10.320 (D), the Planning and Zoning
Commission reviewed the applicant's request for a Conditional Use Permit (CUP) for a tri-plex
on Lot 19A, Block 11, Laubner Addition, Goreson-Carlson Replat, and made the following
Findings of Fact:
A. A completed application and fee was submitted. The application and $250.00 fee was
received by the city on December 19,1996. Although an as-built survey was submitted
showing the building location, it did not show parking spaces, fuel tanks, landscaping
or trash receptacle locations.
B. The use is consistent with the purpose of this chapter and the purposes of the zoning
district, to wit:

'*' Developable Land In Seward Is Scarce Yet There Is A Demand To Accommo-
date As Much Projected Demand For Housing As Possible Within the City
Limits In Order To Ensure Sound Community Growth and Development
'*' Continue every effort to encourage the development of affordable housing for
Seward's growing housing needs -- including single- and multi-family housing
units
The Housing Analysis Update, completed in June 1996, stated that "There is a need
for more unsubsidized rental property. Although rental housing is available year
round, and pricing is reasonable compared with other areas of south central Alaska,
the market is tight.
E. Public Services and facilities are adequate to serve the proposed site. Adequate water,
sewer and power appear to be available to the property as well as adequate fire, police
and solid waste disposal services. There is a need for solid waste disposal container
to accommodate apartment residents. It is recommended one dumpster be provided
on site.
F. The proposed use will not be harmful to the public safety, health or welfare. For the
safety of the tenants and visitors, it is recommended that lighting be provided in the
parking area. All lighting must be arranged to reflect away from adjacent residential
areas and streets.
G. Any and all specific conditions deemed necessary by the commission to fulfill the above-
mentioned conditions shall be met by the applicant. These may include but are not limited
to measures relative to access, screening, site development, building design, operation of
the use and other similar aspects to the proposed use. The Comprehensive Plan
recommends continuing to require landscape plans as part of conditional use permits.
Section 2. Based on the Findings of Fact specified in Section 1, the Planning and Zoning
Commission authorizes the City Clerk to issue a Conditional Use Permit to Dianne Carlson-
Bencardino for the tri-plex on Lot 19A, Block 11, Laubner Addition, Goreson-Carlson Replat,
subject to the following conditions:
1. A site plan will be submitted to the city showing location of parking spaces, any
fuel tanks and solid waste disposal containers.
2. All parking areas and driveways will be paved within one year from the issuance
of the certificate of occupancy.
