RESOLUTION NO. 21:US
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, AMENDING THE CONDITIONAL USE PERMIT ISSUED TO THE
KENAI PENINSULA BOROUGH ON MARCH 7, 1991, TO INCLUDE THE
DEVELOPMENT AND OPERATION OF AN INERT WASTE MONOFILL ON
APPROXIMATELY FIVE ACRES OF BOROUGH LAND WITHIN THE NE 1/4 OF
SECTION 28, TIN, RIW AND DESCRIBED AS KPB TAX PARCEL NUMBER 144-24-01
WHEREAS, on March 7, 1991 the Kenai Peninsula Borough was issued a Conditional
Use Permit (CUP) for the development and operation of a solid waste transfer facility within the
NE 1/4 of Section 28, TIN, RIW, Seward Meridian; and
WHEREAS, a condition of the CUP required that the facility include a scrap metal and
wood waste area to be removed regularly and controlled wood waste burning several times a year;
and
WHEREAS, on January 9, 1997, the City of Seward received from the State Department
of Environmental Conservation a copy of an KPB application for an inert waste monofill facility;
and
WHEREAS, the City of Seward proceeded to inform the KPB that an amendment to the
original Conditional Use Permit would be required prior to construction and operation of the
proposed facility; and
WHEREAS, an amendment to the CUP was requested by the KPB on February 19, 1997
to include the operation of an inert waste monofill, in conjunction with the existing Seward
Transfer Facility.
WHEREAS, a public hearing was held on April 2, 1997 in accordance with SCC ~
15.01.040; and
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. In accordance with SCC ~ 15.10.320, the Commission determined that the
proposed use satisfied all of the conditions required for a Conditional Use Permit based on the
following findings:

Section 2. The Planning and Zoning Commission hereby ratifies its April 2, 1997
approval of an amendment to the Conditional Use Permit, issued to the KPB on March 7, 1991,
and modified by the City Council, acting as the Board of Adjustment, on April 22, 1991, by
permitting the development and operation of an inert waste monofill facility on approximately five
acres of KPB property within the NE 1/4 of Section 28, TIN, Rl W, Seward Meridian.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 7th
day of May, 1997.
