A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, RATIFYING THE MAY 7,1997, DECISION TO GRANT THE
AMERICAN LEGION #5 A CONDITIONAL USE PERMIT TO DEVELOP AND
OPERATE A RIFLE AND PISTOL RANGE ON KENAI PENINSULA BOROUGH
PROPERTY LOCATED AT THE END OF DIMOND BOULEVARD ON A PORTION OF
THE NEI/.i OF SECTION 28, TIN, RIW, SEWARD MERIDIAN
WHEREAS, the American Legion #5 applied for a Conditional Use Permit to develop and
operate a rifle and pistol range on a portion of the NEJA of Section 28, TIN, RIW, Seward
Meridian
WHEREAS, the subject property is zoned Institutional; and
WHEREAS, according to the Zoning Code, Land Uses Allowed Table, (15.10.225) a
shooting range is allowed in the Institutional District by Conditional Use Permit; and
WHEREAS, a duly advertised public hearing, meeting the requirements of SCC Section
15.01.040 was held by the Commission on May 7, 1997.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. In accordance with SCC ~ 15.10.320 (D), the Planning and Zoning
Commission has reviewed the applicant's request for a conditional use permit (CUP) to construct
and operate a shooting range on a portion of the NEJA of Section 28, TIN, RIW, Seward
Meridian and made the following findings of fact and conclusions:
A. A completed application andfee was submitted. The completed application
was received by the Community Development Department on April 21, 1997. The $250.00 fee
was donated by the City of Seward, Parks and Recreation Department.
B. The use is consistent with the purpose of this chapter and the purposes of
the zoning district. The property is zoned Institutional. As of May 22, 1997, the Zoning Code
allows a shooting range in the Institutional District by conditional use permit. The site plan
submitted with the application identifies that the proposed development will meet all required
setbacks.

4. The proposed ATCO building will be placed on an all weather or treated wood
foundation and secured to the ground with anchors and straps;
5. No ammunition will be stored in the storage/office building;
6. Development of the shooting range shall adhere to the National Rifle Association's
safety standard specifications;
7. The proposed access road must be constructed in accordance with Fire Code
requirements;
8. The shooting range will only be open when an approved range master is
supervising the site;
9. Per the 1994 Uniform Fire Code, Appendix II-D the following terms will be met:
a. The range will be supervised by a range master who is certified by a
recognized authority.
b. All range masters will be approved in writing by the Seward Fire Depart-
ment and the Seward Police Department.
c. A plan will be submitted to and approved by the City of Seward Fire
Department which will address inspection of expended ammunition
components and the disposal of malfunctioning ammunition.
d. Portable fire extinguishers will be installed as required by the Seward Fire
Department.
e. The area of designated use will be kept clear of vegetation as specified by
the Seward Fire Department.
f. In lieu of protective fencing, warning signs will be posted completely
around the perimeter of the facility to provide a warning to all approaches.
Section 2. Based on the fmdings and conclusions specified in Section 1, the Planning and
Zoning Commission authorizes the Community Development Department to issue a Conditional
Use Permit to the American Legion #5 for the development and operation of a rifle and pistol
range on a portion of the NE 14 of Section 28, TIN, Rl W, Seward Meridian, subject to the nine
conditions listed in subsection G above.
Section 3. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 4th
day of June, 1997.
