A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, GRANTING A CONDITIONAL USE PERMIT TO
GLACIER COMMUNICATIONS INC., FOR THE CONSTRUCTION OF A
RADIO TOWER WITHIN BLOCK 6, FOURTH OF JULY CREEK
SUBDIVISION, SEWARD MARINE INDUSTRIAL CENTER
WHEREAS, DC Engineering, on behalf of Glacier Communications Inc., has requested
a Conditional Use Permit for the construction of a radio tower within Block 6, Fourth of July
Creek Subdivision, Seward Marine Industrial Center; and
WHEREAS, an application meeting the requirements of Section 15.1O.320(B), was
submitted and received on August 18, 1998; and
WHEREAS, the Land Use Plan and Zoning designation of Block 6, Fourth of July Creek
Subdivision, SMIC is Industrial; and
WHEREAS, in accordance with the Land Uses Allowed Table (15.10.225), Antenna,
commercial satellite dishes and towers, are allowed within the Industrial District by Conditional
Use Permit; and
WHEREAS, a duly advertised public hearing, meeting the requirements of Section
15.01.040 was held by the Commission on September 2, 1998;
NOW, THEREFORE, BE IT RESOLVED BY THE SEWARD PLANNING AND
ZONING COMMISSION of the City of Seward that:
Section 1. In accordance with SCC ~ 15.10.320 (D), the Planning and Zoning Commission
has reviewed the applicant's request for a Conditional Use Permit (CUP) and made the following
Findings of Fact:
A. The use is consistent with the purpose of this chapter and the purposes of the zoning
district. The property is zoned Industrial. The purpose of this Industrial District is for
business, manufacturing, processing, fabricating, repair, assembly, storage, wholesaling
and distributing operations, which may create some nuisance and which are not properly

equipment and materials.
Constructing a radio tower in the Seward Marine Industrial Center appears to be in
harmony with the Comprehensive Plan.
E. Public Services and facilities are adequate to serve the proposed site. This condition
appears to be met for the proposed tower. Power is available to the site. Water and
Sewer are not available, however these services do not appear necessary for the tower.
Fire and police services are limited in the Seward Marine Industrial Center.
F. The proposed use will not be harmful to the public safety, health or welfare. The
proposed tower will be fairly isolated from any other uses or activities, however the site
should be secured to prevent unauthorized access on the tower. According to the Building
Official, a building permit will be required for construction of the tower. The existing
ATCO trailer does not meet building codes and has no water or sewer available.
G. Any and all specific conditions deemed necessary by the commission to fulfill the above-
mentioned conditions shall be met by the applicant. These may include but are not
limited to measures relative to access, screening, site development, building design,
operation of the use and other similar aspects to the proposed use.
Section 2. Based on the Findings of Fact specified in Section 1, the Planning and
Zoning Commission authorizes the Community Development Department to issue a Conditional
Use Permit to Glacier Communications Inc. for the development of a radio tower within Block
6, Fourth of July Creek Subdivision, Seward Marine Industrial Center, subject to the following
conditions:
1. In accordance with the Fourth of July Creek Subdivision, Seward Marine Industrial
Center plat requirements, no portion of the tower, including guy wires and
anchors, may be located within 10 feet of any right-of-way or access easement, and
no portion of the tower may be located within five feet of a side property line;
2. The base of the tower must be fenced in order to prevent unauthorized access;
3. The A Tea trailer, currently located on the property, must meet all zoning
setbacks, and may only be used for the storage of equipment associated with the
tower, except that, the trailer may be used as a temporary office/studio for up to
one year from the effective date of the Conditional Use Permit provided that a
portable toilet is provided on site.
