RESOLUTION NO. 28:11
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, AMENDING THE CONDITIONAL USE PERMIT ISSUED
TO DIANNE CARLSON-BENCARDINO FOR THE TRI-PLEX AT 1103
SECOND AVENUE, ON LOT 19A, BLOCK 11, LAUBNER ADDITION,
GORESON-CARLSON REPLAT
WHEREAS, on February 5, 1997 the Planning and Zoning Commission granted a
Conditional Use Permit to Dianne Carlson-Bencardino to allow a tri-plex at 1103 Second Avenue
on Lot 19A, Block 11, Laubner Addition, Goreson-Carlson Replat; and
WHEREAS, the Conditional Use Permit was subject to seven conditions; and
WHEREAS, on June 12, 1997, November 17, 1997 and August 18, 1998, letters were
sent to the permittee regarding the three unmet conditions of the permit; and
WHEREAS, the specific unmet conditions included paving all parking areas and driveways
(condition number two), presenting a landscape plan to the Planning and Zoning Commission for
review and approval and completing the approved landscaping within one year from the date of
the certificate of occupancy (condition number four), and screening the solid waste dumpster
(condition number five);
WHEREAS, in an August 26, 1998 letter, the permittee explained that it was not possible
to meet permit conditions two, four and five due to the specific characteristics of the property, and
requested that the letter suffice to fulfil any remaining conditional requirements; and
WHEREAS, Seward City Code ~ 15.1O.320(F) allows the Planning and Zoning
Commission to amend approved Conditional Use Permits; and
WHEREAS, amending Dianne Carlson-Bencardino's approved Conditional Use Permit
by deleting conditions two and four, and amending condition number five, will not conflict with
the Zoning Code or be harmful to the public health, safety or welfare;
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Conditional Use Permit issued to Dianne-Carlson Bencardino is hereby
amended by deleting condition number two and four, and amending condition number five by
deleting the requirement that the dumpster be screened on three sides with a solid wood fence.
