RESOLUTION NO. 99-09
A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMIS-
SION, GRANTING JAMES PRUITT A CONDITIONAL USE PERMIT TO
DEVELOP A HOTEL ON ALASKA RAILROAD RIGHT OF WAY LEASE
PROPERTY IN THE HARBOR COMMERCIAL ZONING DISTRICT
WHEREAS, Jim Pruitt applied for a conditional use permit to construct a hotel on Alaska
Railroad right-of-way lease property identified as Kenai Peninsula Borough tax parcels 147-330-22
and 147-330-23; and
WHEREAS, the property's Land Use Plan and Zoning designation is Harbor Commercial;
and
WHEREAS, according to the Seward Zoning Code, Land Uses Allowed Table 15.10.225
hotels and motels are allowed in the Harbor Commercial District by Conditional Use Permit; and
WHEREAS, the Commission held a public hearing and reviewed the proposal at its
December 1 and December 20, 1999 meetings.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. In accordance with SCC ~ 15.10.320 (D), the Planning and Zoning
Commission has reviewed the applicant's request for a conditional use permit (CUP) to construct
a hotel in the Harbor Commercial District and identified the following findings of fact based on
the proposed site plan dated December 1, 1999:
A. A completed application and fee was submitted. The application and $250.00
filing fee was received by the Community Development Department on November 12, 1999. The
property owner's signature on the application was received on November 15, 1999.
B. The use is consistent with the purpose of this chapter and the purposes of the
zoning district. This condition has been met. Hotels and motels are allowed in the HC district
by Conditional Use Permit.
C. The value of adjoining property will not be significantly impaired. There is no
indication that the value of adjoining property will be significantly impaired. The Alaska Railroad
owns and leases the adjoining property to the north and south. The site is surrounded by the Small
Boat Harbor to the east, a public parking lot to the west, and a variety of commercial uses

Strategic Plan (1999)
The Strategic Plan recommends encouraging citizens as well as the city, to take an active role in
beautifying the community by planting trees, shrubs and wildflowers (pg.15). Both harbor
merchants and the City have been working on landscaping projects to beautify the harbor. The
Plan supports the construction of a pedestrian sidewalk between the Alaska Railroad Dock and the
Iditarod Trail at Fourth Avenue and Van Buren Street (pg. 17)
E. Public Services and facilities are adequate to serve the proposed site.
Adequate water, sewer, and power are available to the property as well as adequate fire, police
and solid waste disposal services.
F. The proposed use will not be harmful to the public safety, health or welfare.
The building construction will meet the requirements of the Uniform Building and Fire Codes.
There is no evidence that the proposed development will be harmful to the public safety, health
or welfare.
G. The following conditions shall be met by the applicant:
1. One off-street parking space per guest unit shall be provided for the life of the hotel in
accordance with Seward City Code Section 15.10.215 Parking.
2. A plan for bus ingress and egress must be approved by the City.
3. An extension of the public boardwalk shall be constructed, at developer's expense, along
the waterfront from J-Dock to the north end of the permittee's lease site. The location and
design of the boardwalk must be approved by the Harbormaster, and the boardwalk must
be complete prior to the certificate of occupancy being issued for the building.
4. Driveways and parking areas must be paved, and parking lot lighting installed within one
year after completion of construction.
5. Provide sidewalks, curbs and gutters, at developer's expense and constructed to city
standards, along the east side of Fourth Avenue from J-Dock to the north end of the
permittee's lease site within one year after the certificate of occupancy is issued.
6. Garbage dumpsters must be screened on three sides, and all areas not devoted to buildings,
drives, walks, parking areas or other authorized installations shall be covered with lawn,
shrubbery, trees, potted plants, or other traditional landscape material within one year after
the certificate of occupancy is issued.
7. Provide the City with a copy of the Railroad lease document within 30 days after being
signed by the Alaska Railroad Corporation and Mr. Pruitt.
