RESOLUTION NO. 2000-01
A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMIS-
SION, GRANTING A SETBACK V ARIANCE TO CARL AND KIM HUGHES
FOR AN ALREADY APPROVED BUILDING ON BOARDWALK SITE NO.
3, PORTION OF BLOCK 6, OCEANVIEW SUBDIVISION
WHEREAS, on September 15, 1999, the City of Seward, Community Development
Department approved a site plan submitted by Carl and Kim Hughes for a new office building on
a parcel described as Boardwalk Site No.3, Portion of Block 6, Oceanview Subdivision; and
WHEREAS, on May 1, 2000 the City became aware that the approved plans identified that
the cantilevered eave would extend farther into the setback than the allowed two feet; and
WHEREAS, in August, 1999 Ordinance 99-10 amended the Zoning Code by reducing the
amount of building eave allowed to extend into setbacks from three feet to two feet; and
WHEREAS, following notification from the City that the building design was in violation
of the Zoning Code setback requirements, Carl and Kim Hughes submitted a variance application,
and the required $250.00 filing fee, for a one foot setback encroachment for the building eaves; and
WHEREAS, on May 23, 2000, the Planning and Zoning Commission held the required
public hearing on the variance application.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. According to SCC ~ 15.1 0.325.D., the Commission shall establish a finding that
all of the following conditions have been found to exist prior to issuing a variance permit:
1. The proposed action must he consistent with all of the general conditions required for a
conditional use permit.
A. The use is consistent with the purpose of this chapter and the purposes of the
zoning district. The property is zoned Harbor Commercial (He). According to the
Zoning Code, Land Uses Allowed Table, Offices are allowed outright in the HC
district.

4. Financial hardship or inconvenience shall not be a reason for granting a variance. Although,
the building is over 75% constructed, and correcting the situation would be a significant financial
hardship, the reason for granting the variance is based on the fact that the City erred in approving the
site plan.
5. No nonconforming land uses or structures within the district were considered as grounds for
granting the requested variance. No nonconforming structures were considered in this review.
6. The requested variance is the minimum variance necessary to permit the reasonable use of the
property. As of August, 1999 building eaves are allowed to extend into setbacks a maximum of two
feet. Prior to that, building eaves were allowed to extend into setbacks up to three feet. The design
ofthis building requires a three foot eave for structural strength, therefore a one foot setback variance
is the minimum necessary to complete construction of the building as it was designed and approved.
7. The requested variance will not permit a land use in a district where the use is prohibited. The
property is zoned Harbor Commercial (He) and offices are allowed in the HC district.
Section 2. The Planning and Zoning Commission hereby approves a one foot setback
variance for the cantilevered building eaves on City of Seward lease parcel identified as Boardwalk
Site No.3, Portion of Block 6, Oceanview Subdivision. This variances authorizes the building eaves
to extend a maximum ofthree feet into the required five foot side setbacks.
Section 3. The approved variance does not authorize the vertical posts identified within the
required five foot setbacks on the building elevation drawing dated April 7, 2000.
Section 4. In accordance with Seward City Code S l5.10.325.E., this resolution shall take
effect ten (10) days after its adoption, provided it is not rescinded, amended or appealed.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 23rd day
of May, 2000.
