TO ALLOW A BUNKHOUSE WITHIN THE INDUSTRIAL WNING DISTRICT ON THAT PORTION OF LOT 4, BLOCK 2, LEIRER INDUSTRIAL SUBDIVISION (PRELIMINARY PLAT) SUB- LEASED TO WESTOURS MOTOR COACHES INC. WHEREAS, Westours Motor Coaches Inc. applied for a conditional use permit from the Seward Planning and Zoning Commission to develop a thirteen (13) unit bunkhouse on Lot 4, Block 2, Leirer Industrial Subdivision (preliminary plat); and WHEREAS, the property's Land Use Plan and Zoning designation is Industrial; and WHEREAS, according to the Zoning Code, Land Uses Allowed Table 15.10.225, bunkhouses are allowed in the Industrial District by conditional use permit; and WHEREAS, on June 5, 2001, the Planning and Zoning Commission held the required public hearing on the conditional use permit application. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. According to SCC ~ 15.1 0.320.D., the Commission shall establish a finding that the use satisfies the following conditions prior to granting a conditional use permit: A. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and the purposes of the zoning district. Finding: This condition has been met. The property is zoned Industrial. The Industrial district is for business, manufacturing, processing, fabricating, repair, assembly, storage, wholesaling and distributing operations, which may create some nuisance and which are not properly associated nor compatible with residential land uses. It is intended to provide environmental safeguards for people employed in or visiting the district. Some visual amenity is expected in this district to make it compatible with adjoining residential or business districts. Bunkhouses are allowed in the Industrial District by Conditional Use Permit. Any and all specific conditions deemed necessary by the commission to fulfill the above- mentioned conditions shall be met by the applicant. These may include but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects to the proposed use. 1. A solid waste dumpster shall be required on the property for the bunkhouse, and may not be located within the required front yard setback. Location of the dumpster must be approved by the Community Development Office and solid waste contractor. 2. Prior to the issuance of a building permit, the permittee shall submit a dimensioned site plan which identifies thirteen (13) on-site parking spaces for the bunkhouse, and the vehicle ingress and egress route. 3. All areas not devoted to buildings, structures, drives, walks, off-street parking facilities, or other authorized installations, shall be planted with lawn, trees, shrubs, or flowers. 4. The site plan shall identifY the location of all fuel oil and propane tanks. 5. Although structures designed as detached single-family residences are not allowed within the Industrial District, the smaller structure identified as a manufactured home on the site plan and designed as a single-family home will be modified for use as a bunkhouse either by attachment to the larger structure or interior modification. This condition will be void if the city attorney deems it unnecessary to meet code requirements. Section 2. The Planning and Zoning Commission finds that the proposed use satisfies the conditions for granting a conditional use permit, and authorizes the administration to issue a conditional use permit to Westours Motor Coaches Inc. for a bunkhouse on Lot 4, Block 2, Leirer Industrial Subdivision, preliminary plat, subject to the conditions listed in Section 1, Subsection F. Section 3. The Planning and Zoning Commission finds that adherence to the conditions of this permit is paramount in maintaining the intent of Seward City Code 15.10.320 Conditional use permits, and authorizes the administration to confirm all conditions are satisfied prior to issuing a final certificate of occupancy. Additionally the administration shall periodically confirm that the use conforms to the standards of its approval. Section 4.
