HomeMy WebLinkAboutRes2001-010 Sponsored by: Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION NO. 2001-10 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMIS- SION, GRANTING A CONDITIONAL USE PERMIT TO MICHAEL CLUFF TO DEVELOP A SHOPPING CENTER WITHIN THE AUTO COMMER- CIAL ZONING DISTRICT ON A PORTION OF ALASKA RAILROAD RIGHT -OF -WAY, AND LOT 1, BLOCK 2, NORTH HARBOR SUBDIVISION WHEREAS, Michael Cluffhas applied for a conditional use permit from the Seward Planning and Zoning Commission to develop a multi-unit retail center (shopping center) on a portion of Alaska Railroad Right-of-Way and Lot 1, Block 2, North Harbor Subdivision; and WHEREAS, the property's Land Use Plan and Zoning designation is Auto Commercial; and WHEREAS, according to the Zoning Code, Land Uses Allowed Table 15.1 0.225, shopping centers are allowed in the Auto Commercial District by conditional use permit; and WHEREAS, on June 5, 2001, the Planning and Zoning Commission held the required public hearing on the conditional use permit application. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. According to SCC S 15.1 0.320.D., the Commission shall establish a finding that the use satisfies the following conditions prior to granting a conditional use permit: A. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and the purposes of the zoning district. Finding: This condition will be met. The property is zoned Auto Commercial. The Auto Commercial district is intended to provide areas to accommodate highway-oriented activities such as offices, certain institutional uses, and limited personal services and retail uses requiring substantial outdoor activity, traffic and parking, and which also serve the offices and nearby residential areas, and which do not materially detract from nearby residential areas. A shopping center is allowed in the Auto Commercial District by conditional use permit from the Planning and Zoning Commission. The preliminary site plan, by William Edgar Merry & Associates Inc., dated March 09,2000, does not meet all of the Zoning Code development requirements, and must be revised to identify that the project will meet all Zoning Code development requirements including setbacks, lot coverage, building height, and parking. The development must meet all Zoning Code development requirements including but not limited to building height, setbacks, lot coverage and parking. A revised site plan must be submitted and approved by the administration prior to the issuance of a building permit. 3. A solid waste dumpster shall be required on the property, may not be located within the required front or side yard adjacent to a street setbacks, and shall be screened on three sides with a solid material fence. Location of the dumpster must be approved by the Community Development Office and solid waste contractor. Construction waste and debris must be removed weekly and upon completion of construction. 4. The existing building on Lot 1, Block 2, North Harbor Subdivision must be removed prior to completion of the new multi-unit retail building. 5. The required parking area must be paved within one year from the completion of the building, which shall be identified as the date the certificate of occupancy is issued. 6. All areas not devoted to buildings, structures, drives, walks, off-street parking facilities, or other authorized installations, shall be planted with lawn, trees, shrubs, or flowers. Permittee shall provide a landscape buffer on Lot 1, Block 2, North Harbor Subdivision between the Seward Highway right-of-way and the proposed parking lot subject to approval by the P&Z Commission. 7. Upon administration review, applicant may be required to submit a modification application subject to a public hearing and filing fee as required by Seward City Code Section 15.10.320. 8. The site plan must identify a safe area for loading and unloading that does not impact parking or access areas. 9. The fuel oil and/or propane tanks must be identified on the site plan and approved by the Community Development Office. 10. The required parking must be provided on Lot 1, Block 2, North Harbor Subdivision for the life of the use, and as required by the Seward Zoning Code Section 15.10.215 (E), made subject to a recorded agreement. Section 2. The Planning and Zoning Commission finds that the proposed use satisfies the conditions for granting a conditional use permit, and authorizes the administration to issue a conditional use permit to Michael Cluff to allow a shopping center on a portion of Alaska Railroad Right-of-Way, and Lot 1, Block 2, North Harbor Subdivision subject to the conditions listed in Section 1, Subsection F. \\,UIIIII" ~"\~,,\,,, =10 .2/"#~" -..... ~ ..1.....
