RESOLUTION NO. 2001-15 Substitute
RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMIS-
SION, RECOMMENDING THAT THE CITY REQUEST AN ACCESS AND
UTILITY EASEMENT ALONG THE EXISTING BALLFIELD ACCESS
ROAD FROM THE KENAI PENINSULA BOROUGH
WHEREAS, there is no legal document providing public or city access to the high school
ballfield and Citizen's Field, or for the city utilities located within this corridor; and
WHEREAS, the current "ballfield access road" located on Borough property between the
high school track and the City Cemetery originated from the clearing and construction of a city water
line in 1979; and
WHEREAS, the City of Seward public works department has maintained the access road
with occasional grading; and
WHEREAS, there is a need to legally formalize the access and utility corridor; and
WHEREAS, an access easement accomplishes the goal of legal access without requiring
subdivision of the borough school site and the resulting estimated cost to the City of Seward of
$2,000 to $3,000 (estimated cost of the easement would involve less administrative time with
potentially the only cash expenditure being recording fees for the document); and
WHEREAS, dedication and extension of this road are not included in any published City of
Seward plan and future transportation needs ofthis area have not been fully addressed since the 1990
Comprehensive Plan Update; and
WHEREAS, obtaining an access easement rather than a right-of-way dedication does not
preclude the road being extended through to Hemlock Street if it is desired at some future time to
provide a local transportation corridor between Forest Acres and Jesse Lee Heights Subdivision and
the two schools, as an alternative to using the Seward Highway; and
WHEREAS, Seward Schools Site Council discussed the proposed right-of-way dedication
at their October 11, 2001 meeting without reaching a decision for support or non-support. The
minutes reflect concerns voiced which could not be answered regarding impact to nearby track and
trails used for running and cross-country skiing and likely loss of space for elementary play areas; and
