A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMIS-
SION, GRANTING A CONDmONAL USE PERMIT TO JAMES T. PRUITT
TO DEVELOP A HOTEL 1VITHIN THE HARBOR COMMERCIAL
ZONING DISTRICT ON ALASKA RAILROAD RIGHT-OF-WAY LEASE
PROPERTY
WHEREAS, James Pruitt has applied for a conditional use permit from the Seward Planning
and Zoning Commission to develop a hotel on Alaska Railroad Right-of-Way lease property; and
WHEREAS, the property's Land Use Plan and Zoning designation is Harbor Commercial;
and
WHEREAS, according to the Zoning Code, Land Uses Allowed Table 15.10.225, hotels and
motels are allowed in the Harbor Commercial District by conditional use permit; and
WHEREAS, on January 8,2002, the Planning and Zoning Commission held the required
public hearing on the conditional use permit application.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. According to SCC ~ 15.1O.320.D., the Commission shall establish a finding that
the use satisfies the following conditions prior to granting a conditional use permit:
A. The use is consistent with the purpose of this chapter (the Seward Zoning Code) and the
purposes of the zoning district.
Finding: This condition has been met. The property is zoned Harbor Commercial. The
Harbor Commercial district is intended to provide an area for water-dependent or water-
related uses with particular emphasis on transportation, tourist, recreational, commercial or
industrial enterprises which derive major economic or social benefit from a harbor location.
A hotel is allowed in the Harbor Commercial District by conditional use permit from the
Planning and Zoning Commission.
B. The value of a4joining property will not be significantly impaired
Finding: This condition has been met. The property is surrounded by the Small Boat
Harbor to the east, a public parking lot to the west, and a variety of commercial businesses
including: gift, bike and candy shops, auto and marine parts store, restaurants, charter offices,
boat storage, fish processing, yadlt club, and gas station. There is no indication that the
proposed hotel will negatively impact the value of adjoining property.

structures in order to prevent building development from blocking shoreline access
and views ofthe boats within the Harbor (pg 22).
Stratel!ic Plan (1999)
The Strategic Plan recommends encouraging citizens as well as the city, to take an active role
in beautifYing the community by planting trees, shrubs and wildflowers (pg.15). Both harbor
merchants and the City have been working on landscaping projects to beautifY the harbor.
D. Public Services and facilities are adequate to serve the proposed site.
Finding: Specific conditions are necessary to ensure this condition has been met.
Adequate water, sewer, and power are available to the property, as well as adequate police
and solid waste disposal services. There are water, electric and telephone lines located on the
property. The City's water and electric lines are authorized by contract agreements with the
Alaska Railroad Corporation. The building may not be constructed over these utility lines.
According to the Fire Chief, an additional fire hydrant will be required along Fourth Avenue,
and the boardwalk will need to be at least 10 feet wide to accommodate ground ladders to
access the third floor windows on the east (waterfront) side of the building. There is an
identified public need for public restrooms in this area of the harbor.
E. The proposed use will not be harmful to the public safety, health or welfare.
Finding: In order to meet this condition, specific conditions are necessary. The building
construction must meet the requirements ofthe City's adopted building and fire codes. Five
driveways for this property are excessive considering there is only 465.64 feet of frontage.
This many driveways would negatively impact traffic safety by creating conflicts between
pedestrians and vehicles traveling on 4th Avenue and traffic entering and exiting the property.
The site plan does not identifY the location of fuel and/or propane tanks, and safe area for
loading and unloading freight.
F. Any and all specific conditions deemed necessary by the commission to fulfill the above-
mentioned conditions shall be met by the applicant. These may include but are not
limited to measures relative to access, screening, site development, building design,
operation of the use and other similar aspects to the proposed use.
1. A recorded subdivision of the property must be completed prior to construction in
order to accurately identifY the portion of Alaska Railroad Right-of-Way subject to this Conditional
Use Permit.
2. One off-street parking space per guest unit shall be provided for the life of the hotel.
The required parking must meet the requirements of Seward City Code 15.10.215 Parking.
3. The required parking area must be paved, and parking lot lighting installed within one
year after completion of the construction.
4. No more than three driveway curb cuts shall be allowed for the property.

T. Pruitt to allow a hotel on Alaska Railroad Right-of-Way lease property subject to the above
conditions.
Section 3. The Planning and Zoning Commission finds that adherence to the conditions of
this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320 Conditional
use permits, and authorizes the administration to confirm all conditions are satisfied prior to issuing a
final certificate of occupancy. Additionally, the administration shall periodically confirm the use
conforms to the standards of its approval.
Section 4. This resolution shall take effect 10 days following its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 8th day of
January, 2002.
