RESOLUTION NO. 2002-03
RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMIS-
SION, RECOMMENDING CITY COUNCIL AND KENAI PENINSULA
BOROUGH APPROVAL OF AN APPLICATION TO VACATE THE
REMAINING ALLEY WITHIN BLOCK 3, OCEANVIEW SUBDIVISION
WHEREAS, the owners of Lots 7, 8,9 and 10, Block 3, Oceanview Subdivision have
proposed to vacate the existing alley located between the lots; and
WHEREAS, in 1972, the majority of this alley was vacated to create Tract A, and allow for
the subsequent development of Bays ide Apartments; and
WHEREAS, the vacated alley was replaced with a 20 foot utility easement to cover the
existing utilities; and
WHEREAS, under the authority of Alaska Statutes, the Kenai Peninsula Borough is
responsible for all vacation requests within the Borough. If the Borough Planning Commission
approves the vacation, the Seward City Council has thirty (30) days from that decision to veto the
approval if it so desires; and
WHEREAS, it is appropriate for the City to provide the Borough with a recommendation on
a proposed vacation located inside the city limits; and
WHEREAS, both the City of Seward Comprehensive Plan and the Municipal Lands
Management Plan recommend vacating all unnecessary and unbuildable right-of-ways throughout the
community; and
WHEREAS, the existing platted alley currently dead ends with no turning radius at Tract A,
Oceanview Subdivision, is not constructed or maintained by the city for public use, and is not
necessary to access private property; and
WHEREAS, the existing electric, sewer, telephone and cable utilities that are located within
this alley must be maintained with a public utility easement as requested by the utility companies.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
