RESOLUTION NO. 2002-04
RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMIS-
SION, RECOMMENDING THAT THE CITY COUNCIL AUTHORIZE THE
DISPOSAL OF LOT 2, BLOCK 1, FOURTH OF JULY CREEK
SUBDIVISION, SEWARD MARINE INDUSTRIAL CENTER FOR SALE TO
SHORESIDE PETROLEUM, INC. FOR NO LESS THAN THE 2000
APPRAISED VALUE OF $22,296
WHEREAS, Shoreside Petroleum, Inc. has submitted a proposal to purchase Lot 2, Block 1,
Fourth ofJuly Creek Subdivision, Seward Marine Industrial Center; and
WHEREAS, the 29,995 square foot parcel is located east of Nash Road at 3306 Jellison
Avenue and is zoned Industrial; and
WHEREAS, Shoreside Petroleum, Inc. has leased this property since 1988, and have
developed the site with a bulk fuel plant; and
WHEREAS, since the Seward Marine Industrial Center was developed in the 1980' s, it has
been identified and marketed as available for disposal by long term lease; and
WHEREAS, land values in the Seward Marine Industrial Center decreased significantly
between 1995 and 2000 because the demand for land at SMIC is static with ample land available for
development and no significant change anticipated in the foreseeable future; and
WHEREAS, in 1995 the appraised fair market value of the property was $45,000, and in
2000 the land value was determined to be $22,000; and
WHEREAS, Seward City Code S 7.05.120, authorizes the City Council to dispose of real
property by negotiation, public auction or sealed bid; and
WHEREAS, Shoreside Petroleum, Inc. has also requested a utility easement to cover the
existing underground fuel pipeline that runs from Shoreside's lease parcel to the North Dock; and
WHEREAS, City Code 7.05.115 considers an easement to be a form of disposition of an
interest in public property, and the City Council must approve easements for more than 20 years.
