RESOLUTION NO. 2002-21
RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, PROVIDING A RECOMMENDATION TO THE CITY
COUNCIL REGARDING THE LEASE OF TIDELANDS SOUTH OF
PROPERTY OWNED BY ALASKAN BARGE & SALVAGE, INC, WHICH
HAS A LEGAL DESCRIPTION OF SW T01S R01 W SOl PORTION E 1/2
NW 1/4, WHICH HAS PROPERTY LINES FORMING THE EAST AND
WEST BOUNDARIES (APPROXIMATELY 1340 LINEAR FEET) OUT
TO THE MEAN LOW WATER MARK
WHEREAS, Alaskan Barge & Salvage, Inc. has submitted a proposal to lease city-
owned tidelands South of property owned by the applicant, which has a legal description ofSW
T01S R01W SOl portion E 1/2 NW 1/4 which has property lines forming the East and West
boundaries (approximately 1340 linear feet) out to the mean low water mark; and
WHEREAS, the applicant will need to provide the City of Seward with a legal
description ofthe tidelands prior to fmallease approval, and
WHEREAS, a renewable short-term lease would formalize existing operations by the
applicant on the City Tidelands, which has taken place over thirty years; and
WHEREAS, the applicant would like to develop a marina and multi use shipping facility
in the tidelands; and
WHEREAS, at its regularly scheduled meeting of June 25, 2001, the City Council
resolved via Resolution 2001-080 to support the development of McDonald Point into a marina
and multi-use shipping facility and authorized the City Manager to monitor and assist Alaska
Barge & Salvage, Inc.; and
WHEREAS, in 1985 the applicant obtained an Army Corps of Engineers permit
authorizing dredging for a channel and yearly maintenance of the tideland, and the necessary
certificates were obtained from the Alaska Department of Environmental Conservation and the
Alaska Division of Governmental Coordination; and
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Commission finds that entering into a renewable short-term lease ofthe City-
owned tidelands South of property owned by Alaska Barge & Salvage, Inc., which has a l~gal
description ofSW T01S ROl W SOl portion E 1/2 NW 1/4 which has property lines forming the
