RESOLUTION 2003-01
A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION,
GRANTING A CONDITIONAL USE PERMIT TO CARLILE
TRANSPORTATION SYSTEMS, INC., FOR THE USE OF A TRAILER,
TEMPORARY OFFICE IN THE INDUSTRIAL ZONING DISTRICT UPON A
PARCEL OF LAND LOCATED WITHIN U.S. SURVEY 9000, THE ALASKA
RAILROAD SEWARD TERMINAL RESERVE SITUATED IN THE SEWARD
RECORDING DISTRICT, THIRD JUDICIAL DISTRICT, STATE OF ALASKA
AND MORE SPECIFICALLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTH SHORELINE AND THE WEST EDGE OF
THE ALASKA RAILROAD FREIGHT DOCK, THENCE NORTH
APPROXIMATELY 435 FEET AND 75 FEET WEST OF THE SHORELINE OF
THE LOG LAGOON TO THE SOUTHEAST CORNER OF SAID PARCEL AND
THE TRUE POINT OF BEGINNING. THENCE CONTINUING NORTH ALONG
THE WEST SIDE OF THE FREIGHT DOCK ACCESS ROAD 400 FEET TO
THE NORTHEAST CORNER OF SAID PARCEL. THENCE IN A WESTERLY
DIRECTION, 50 FEET TO THE NORTHWEST CORNER OF SAID PARCEL.
THENCE IN A SOUTHERLY DIRECTION, 50 FEET WEST AND PARALLEL
TO THE FREIGHT DOCK ACCESS ROAD, A DISTANCE OF 400 FEET TO
THE SOUTHWEST CORNER OF SAID PARCEL. THENCE EASTERLY 50
FEET TO THE SOUTHEAST CORNER OF SAID PARCEL AND THE TRUE
POINT OF BEGINNING, CONTAINING 20,000 SQUARE FEET, MORE OR
LESS.
WHEREAS, Carlile Transportation Systems, Inc. has applied for a conditional use
permit from the Seward Planning and Zoning Commission to have a Trailer, temporary office
use on a portion of land owned by the Alaska Railroad Corporation in order to support their
freight terminal operations; and
WHEREAS, they have a special land use permit from the property owner; and
WHEREAS, the property is in the Industrial Zoning District; and
WHEREAS, according to the Seward City Code, Land Uses Allowed Table 15.10.225,
"Trailer, temporary office" is a conditionally permitted use in the Industrial Zoning District; and

D. Public Services and facilities are adequate to serve the proposed use.
Finding: Power is available to the property. The office will have bottled water for
drinking and will have a self contained toilet. A fIre hydrant is within a distance
specifIed by the Fire Chief and a dumpster is on-site.
E. The proposed use will not be harmful to the public safety, health or welfare.
Finding: This condition has been met. The trailer is of solid quality construction.
The Fire Chief has provided guidance on the placement of containers and the dumpster.
F. Any and all specific conditions deemed necessary by the commission to fulfill the
above-mentioned conditions shall be met by the applicant. These may include but are
not limited to measures relative to access, screening, site development, building design,
operation of the use and other similar aspects related to the proposed use.
1. The use of the trailer for a temporary office shall be for one year, and the trailer
shall be removed or placed on a permanent foundation when the use of the trailer
as an office has been discontinued for six months. The users shall have the option
for two one year renewals, to be granted by staff providing they remain in
compliance.
2. The trailer shall be skirted with an attractive material.
3. Designated parking for fIve (5) vehicles shall be provided adjacent to the
building.
Section 2. The Planning and Zoning Commission fInds that the proposed use, subject to the
above conditions satisfIes the criteria for granting a conditional use permit provided the
conditions listed on Section 1, Subsection F are met by the applicant, and authorizes, the
administration to issue a conditional use permit to Carlile Transportation Systems, Inc. to allow a
trailer to be used for a temporary office located on the Alaska Railroad Lease Site 8418,
commencing approximately 435 feet north of the Alaska Railroad Freight Dock and
approximately 75 feet west of the log lagoon shoreline.
Section 3. The Planning and Zoning Commission fInds that adherence to the conditions of
this permit is paramount in maintaining the intent of Seward City Code Section 15.10.320
Conditional use permits, and authorizes the administration to issue a conditional use permit.
Additionally, the administration shall periodically confIrm the use conforms to the standards of
its approval.
Section 4.
This resolution shall take effect 10 days following its adoption.
