COMMISSION OF THE CITY OF SEWARD, ALASKA, RESCINDING
RESOLUTION 2002-26, A RESOLUTION OF THE SEWARD PLANNING
AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA,
RECOMMENDING THAT THE CITY COUNCIL AMEND TABLE
15.10.225. LAND USES ALLOWED TO ALLOW TEMPORARY OFFICES
BY ADMINISTRATIVE PERMIT IN THE INDUSTRIAL ZONING
DISTRICT
WHEREAS, Resolution 2002-26, recommending that the City Council amend Table
15.10.225. Land Uses Allowed to allow temporary offices by administrative permit in the
Industrial Zoning District was passed at the December 3rd regularly scheduled meeting of the
Seward Planning and Zoning Commission; and
WHEREAS, upon review by the City Attorney it was determined that the proposed
ordinance accompanying Resolution 2002-26 was not consistent with the International Building
Code, presented too many enforcement problems and used language that was too vague; and
WHEREAS, rescinding Resolution 2002-26 would continue to provide for orderly
development of the community, which is the intent of the zoning ordinances in the Seward City
Code.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. The Commission shall rescind Resolution 2002-26, a Resolution of the
Seward Planning and Zoning Commission of the City of Seward, Alaska, recommending that the
City Council amend Table 15.10.225. Land Uses Allowed to allow temporary offices by
administrative permit in the Industrial Zoning District.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the Seward Planning and Zoning Commission this 1st day of
April 2003.

A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION OF THE CITY OF SEWARD, ALASKA,
GRANTING A CONDITIONAL USE PERMIT TO SALTWATER
SAFARI COMPANY, INC. FOR A TWELVE (12) UNIT HOTEL IN
THE HARBOR COMMERCIAL ZONING DISTRICT, AT 1210
FOURTH AVENUE, LOT 12, BLOCK 6, SEWARD SMALL BOAT
HARBOR SUBDMSION
WHEREAS, Saltwater Safari Company, Inc. has applied for a conditional use
permit from the Seward Planning and Zoning Commission to develop a twelve (12) unit
hotel on a site leased from the City of Seward at 1210 Fourth A venue, Lot 12, Block 6,
Seward Small Boat Harbor; and
WHEREAS, the property is in the Harbor Commercial Zoning District; and
WHEREAS, according to the Seward City Code, Land Uses Allowed Table
15.10.225, hotels are allowed in the Harbor Commercial Zoning District as a
conditionally permitted use; and
WHEREAS, operating a twelve unit hotel will contribute to the economic
development of this property and the surrounding properties, which serve a similar
clientele; and
WHEREAS, the modifications and improvements to the existing building will
make it more attractive; and
WHEREAS, the public notification process has been complied with.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. According to SCC 15.I0.320.D., the Commission shall establish a finding
that the use satisfies the following conditions prior to granting a conditional use permit:
A. The use is consistent with the purpose of this chapter (the Seward Zoning Code)
and the purposes of the zoning district.
Finding: This condition has been met. The property is zoned Harbor
Commercial (He). The Harbor Commercial Zoning District provides an area for

harbor and surrounding area.
Small Boat Harbor Manal!ement Plan (1993)
The Small Boat Harbor Management Plan (1993) emphasizes the Comprehensive Plan's
statement that commercial uses in the harbor should be targeted to those that strengthen
and enhance the Small Boat Harbor as a center for marine/tourist convenience uses, and
recommends limiting the Small Boat Harbor commercial development to water related
and water dependent uses only (page 9). The plan further identifies the following issues
and recommendations:
· The available public and private parking does not meet the current parking needs
of existing businesses and the Marina (page 13);
· Recommends increased landscaping in conjunction with development projects
(page 21), and
· Recommends limiting future building heights East of Fourth Avenue to one-story
structures in order to prevent building development from blocking shoreline
access and views of the boats within the Harbor (page 22).
D. Public Services and facilities are adequate to serve the proposed use.
Finding: Water, sewer, telephone and electrical service are available to the
property, as well as adequate emergency services. Solid waste disposal is
available in the harbor area.
E. The proposed use will not be harmful to the public safety, health or welfare.
Finding: In order to meet this condition, specific conditions will have to be
met. A Floodplain Development Permit will need to be obtained, as the property
is in Flood Zone A, as per Panel 3265 of 6375, Flood Insurance Rate Map,
Federal Emergency Management Area, effective date May, 19, 1991. An off-site
parking area with landscaping will be needed. All necessary State and Federal
permits and regulations must be acquired and complied with.
F. Any and all specific conditions deemed necessary by the commission to fulfill
the above-mentioned conditions shall be met by the applicant. These may
include but are not limited to measures relative to access, screening, site
development, building design, operation of the use and other similar aspects
related to the proposed use.
1. The off site parking area must be landscaped, in order to present an
attractive appearance and to lessen erosion caused during heavy rainfall
events.
2. One off-street parking space per guest unit shall be provided for the life of
the hotel. The required parking must meet the requirements of Seward
