HomeMy WebLinkAboutRes2003-011 Sponsored by: Staff CITY OF SEWARD, ALASKA PLANNING AND ZONING COMMISSION RESOLUTION 2003-11 A RESOLUTION OF THE SEWARD PLANNING AND ZONING COMMISSION OF THE CITY OF SEWARD, ALASKA, GRANTING A CONDITIONAL USE PERMIT TO ULTIMATE TOURS, LLC., DBA GODWIN GLACIER DOGSLED TOURS TO HAVE A "TRAILER, TEMPORARY OFFICE" IN THE INDUSTRIAL ZONING DISTRICT AT KENAI PENINSULA BOROUGH TAX PARCEL # 145-025-15, LOCATED ALONG THE SOUTH SIDE OF AIRPORT ROAD WITHIN U.S. SURVEY 9000, THE ALASKA RAILROAD SEWARD TERMINAL RESERVE SITUATED IN THE SEWARD RECORDING DISTRICT, THIRD JUDICIAL DISTRICT, STATE OF ALASKA WHEREAS, Ultimate Tours, LLC. dba Godwin Glacier Dogsled Tours has applied for a conditional use permit from the Seward Planning and Zoning Commission to have a "Trailer, temporary office" use on land owned by the Alaska Railroad Corporation in order to provide support for their chartered touring business; and WHEREAS, they have a special land use permit from the property owner, the Alaska Railroad Corporation; and WHEREAS, the property is in the Industrial Zoning District; and WHEREAS, according to the Seward City Code, Land Uses Allowed Table 15.10.225, "Trailer, temporary office" is a conditionally permitted use in the Industrial Zoning District; and WHEREAS, according to the Seward City Code, Land Uses Allowed Table 15.10.225, offices for charters are a use permitted outright in the Industrial Zoning District; and WHEREAS, the public notification process has been complied with; and WHEREAS, on June 3, 2003, the Planning and Zoning Commission held the required public hearing on the conditional use permit application. NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning Commission that: Section 1. D. Public Services and facilities are adequate to serve the proposed use. Finding: Power can be extended to the property. The site has vehicular access via private driveway. A dumpster location shall be designated on the site plan. An emergency water supply is located at the airport and is sufficient to provide fire protection for this use. The office will have bottled water for drinking and a self-contained toilet. An individual well and septic system mayor may not be allowed on this site. Issuance ofthe Conditional Use Permit allowing temporary use of a self-contained toilet and any future individual well or septic system does exempt the permittee from adherence to requirements of 14.20.010. Use of public sewers is required at time of connection. Permittee is cautioned that it is unlawful according to 14.20.015 to discharge sewage in any unsanitary manner on public or private lands or any natural outlet within the City Limits of Seward. E. The proposed use will not be harmful to the public safety, health or welfare. Finding: In order to meet this condition, the permittee must adhere to the code of the City of Seward and the specific condition deemed necessary by the Commission. The following issues have been identified; usage of the trailer for an office is only to be temporary, natural vegetation needs to be maintained to preserve visual amenities and limit overland surface flow and erosion, the semi- truck with the business logo needs to be parked inconspicuously, handicap parking needs to be identified with proper signage and a dumpster site needs to be identified. F. Any and all specific conditions deemed necessary by the commission to fulfill the above-mentioned conditions shall be met by the applicant. These may include but are not limited to measures relative to access, screening, site development, building design, operation of the use and other similar aspects related to the proposed use.
