A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION OF THE CITY OF SEWARD, ALASKA,
GRANTING A CONDITIONAL USE PERMIT TO RICHARD AND
MELODY JORDAN TO CONSTRUCT (interior remodel) AND
OPERATE A FIVE (5) UNIT HOTEL ON LOT 1,2, & 3, BLOCK 14,
ORIGINAL TOWNSITE OF SEWARD, 335 THIRD AVENUE
WHEREAS, Richard and Melody Jordan have applied for a Conditional Use
Permit from the Seward Planning and Zoning Commission to remodel and operate a five
(5) unit hotel on Lot 1, 2, & 3, Block 14, Original Townsite of Seward, 335 Third
Avenue; and
WHEREAS, the property is located in the Central Business Zoning District; and
WHEREAS, according to the Seward City Code, Land Uses Allowed Table
15.10.225, a hotel is allowed in the Central Business Zoning District as a conditionally
permitted use; and
WHEREAS, having complied with the public notification process; on August 3,
2004, the Seward Planning and Zoning Commission held the required public hearing on
the Conditional Use Permit application.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. According to SCC 15.1O.320.D., the Commission shall establish a finding
that the use satisfies the following conditions prior to granting a conditional use permit:
A. The use is consistent with the purpose of this chapter (the Seward Zoning Code)
and the purposes of the zoning district.
Finding: This condition has been met. The property is zoned Central
Business District (CBD). The Central Business district is intended to provide for
convenient, attractive, concentrated commercial development intended for retail,
fmancial, entertainment and professional services occurring within enclosed
structures. A hotel is allowed in the Central Business District by conditional use
permit from the Planning and Zoning Commission. No adverse impacts to
adjoining properties or other properties in the neighborhood or the Central
Business District are anticipated. The applicant is currently in the process of

include but are not limited to measures relative to access, screening, site
development, building design, operation of the use and other similar aspects
related to the proposed use.
Based on the above findings and conclusions, approval of the CUP shall be
subject to the following conditions:
1. Interior lot line vacation of Lots 1, 2, and 3, Block 14, OTS shall be
submitted to the Kenai Peninsula Borough for fmal approval before a
Certificate of Occupancy is issued.
2. Construction waste and debris shall be removed weekly and upon
completion of construction.
3. One off-street parking space per guest unit and one handicap space shall
be provided for the life of the hotel. The required parking must meet the
requirements of Seward City Code 15.10.215, Parking and be approved
through the Building Permit process.
4. Dumpster to be located off the rear alley.
5. Existing non-conforming sign be removed in accordance with City Code.
6. Traffic ingress and egress plan be submitted and approved by the City.
7. Submit a landscape plan to be approved by staff.
8. Modification of final approval of a conditional use permit may, upon
application by the permitee, be modified by the Planning and Zoning
Commission:
a. When changed conditions cause the conditional use to no longer
conform to the standards for its approval.
b. To implement a different development plan conforming to the
standards for its approval.
c. The modification plan shall be subject to a public hearing and a
filing fee set by City Council Resolution.
Section 2. The Planning and Zoning Commission fmds that the proposed use, subject
to the above conditions satisfies the criteria for granting a conditional use permit
provided the conditions listed in Section I, Subsection F. are met by the applicant, and
authorizes the administration to issue a conditional use permit for a five (5) unit hotel and
retail/office space to Melody and Richard Jordan at 335 Third Ave, Lots 1, 2, and 3,
Block 14, OTS, subject to the above conditions.
