A RESOLUTION OF THE SEWARD PLANNING AND
ZONING COMMISSION OF THE CITY OF SEWARD,
ALASKA, GRANTING A CONDITIONAL USE PERMIT TO
AFOGNAK CONSTRUCTION AND EXCAVATING, INC.,
FOR GRAVEL EXTRACTION FROM JAPANESE CREEK
WEST OF THE LEVEE, AND GRAVEL PIT OPERATIONS
AT LOTS CL AND CM, FOREST ACRES SUBDIVISION
WHEREAS, Afognak Construction and Excavating, Inc has applied for a
Conditional Use Permit from the Seward Planning and Zoning Commission to: extract
gravel from Japanese Creek west of the levee, which has a legal description of
Government Lot 1 & NE 1/4 NE 1/4 of Section 33 and for gravel pit operations at Lots
CL and CM, Forest Acres Subdivision; and
WHEREAS, these properties are located in the Resource Management Zoning
District; and
WHEREAS, according to the Seward City Code, Land Uses Allowed Table
15.10.225, a "bulk material, i.e., concrete, gravel, sand, asphalt" and "resource extraction,
commercial surface, i.e., gravel" is allowed in the Resource Management Zoning District
as a conditionally permitted use; and
WHEREAS, the gravel will be used for ongoing construction activities
throughout the community on an as needed basis; and
WHEREAS, allowing gravel extraction and processing promotes economIC
development and improvement of infrastructure within the community; and
WHEREAS, extracting gravel from the banks of the Japanese Creek west if the
levee helps mitigate flooding by increasing the area available for flood water flows; and
WHEREAS, having complied with the public notification process; on April 5th,
2005, the Seward Planning and Zoning Commission held the required public hearing on
the Conditional Use Permit application.
NOW, THEREFORE, BE IT RESOLVED by the Seward Planning and Zoning
Commission that:
Section 1. According to SCC 15.10.320.D., the Commission shall establish a fmding
that the use satisfies the following conditions prior to granting a conditional use permit:

include but are not limited to measures relative to access, screening, site
development, building design, operation of the use and other similar aspects
related to the proposed use.
Based on the above findings and conclusions, approval of the CUP shall be
subject to the following conditions:
1. A traffic control plan shall be required, which shall include the days and
hours of operation along the haul route. The plan will be subject to staff
approval.
2. Hours of operation shall not exceed 7 am to 10 pm.
3. A floodplain development permit shall be required prior to extracting
gravel from Japanese Creek west of the levee.
4. The Japanese Creek stream banks and the vegetation shall not be altered or
disturbed during gravel extraction operations.
5. This permit only authorizes the activity, if any issues involving stream
flow, gravel rights or rights to other resources are involved, the applicants
shall address those concerns through separate processes.
6. Fuel storage shall not be allowed onsite for the Japanese Creek west ofthe
levee gravel extraction operations nor during gravel pit operations.
7. Adequate sanitation facilities, such as portable latrines, shall be onsite at
both the Japanese Creek gravel extraction and the gravel processing at
Lots CL and CM, Forest Acres Subdivision and shall be removed during
periods of non-operation.
8. Storage piles shall not be left on site after September 15th of each year.
9. Issuance of this permit does not alleviate the applicant's responsibility to
obtain all local, state and federal permits, if required.
10. Modification of final approval of a conditional use permit may, upon
application by the permittee, be modified by the Planning and Zoning
Commission:
a. When changed conditions cause the conditional use to no longer
conform to the standards for its approval.
b. To implement a different development plan conforming to the
standards for its approval.
c. The modification plan shall be subject to a public hearing and a
filing fee set by City Council Resolution.
