RESOLUTION 2005-23
A RESOLUTION OF THE SEWARD PLANNING AND ZONING
COMMISSION, RECOMMENDING KENAI PENINSULA BOROUGH
APPROVAL OF THE REQUEST BY THE NA TIONAL PARK SERVICE
FOR VACATION OF THE EAST HALF OF WASHINGTON STREET
BETWEEN FOURTH AND FIFTH AVENUE, EXCLUSIVE OF THE
ALLEY INCLUDING ANY ASSOCIATED UTILITY EASEMENTS
WHEREAS, the National Park Service has submitted a request to the City of Seward to
vacate a portion of Washington Street for review and recommendation to the Kenai Peninsula
Borough; and
WHEREAS, the applicants wish to use the vacated portion of Washington Street to
construct the Mary Lowell Center, a multi-agency facility which will provide administrative
offices and visitor services for the National Park Service, US Forest Service and a conference
facility for use by visitors to Seward and the preceding agencies and the City of Seward; and
WHEREAS, a mini-Value Analysis (V A) team including representatives from the Park
Service, Forest Service and City of Seward came to a consensus using the Choosing by
Advantages (CBA) process and recommended a footprint spanning the east half of a vacated
Washington Street; and
WHEREAS, constructing one building for the Mary Lowell Center at this location will
provide more connectivity to visitor related businesses, shared operation and maintenance
expenses, ideal waterfront connection, an unobstructed view from the conference facility and has
the potential to contribute to the revitalization ofthe downtown area; and
WHEREAS, Washington Street is located in the Central Business District and the
vacated portion would become land owned by the adjacent land owner, the National Park
Service; and
WHEREAS, in accordance with Seward City Code, the Commission held a public
hearing on the request to vacate at their October 6, 2005 regular meeting; and
WHEREAS, in addition to those findings contained in the preceding whereas statements,
the Seward Planning Commission approved the following findings which support vacating the
east half of Washington Street between Fourth and Fifth Avenues, exclusive of the alley, and the
associated utility easements:

Section 1. The Commission recommends that the Kenai Peninsula Borough approve the
request of the National Park Service to vacate the East half of Washington Street between Fourth
and Fifth Avenue, exclusive of the alley and the associat_ed utility easements, with the following
conditions:
1. An East-West pedestrian easement shall be provided at the North boundary of
the vacated area of Washington Street or at a location in Block 9, Original
Townsite of Seward, which will allow pedestrian access to Fourth Avenue.
2. A vehicular and pedestrian traffic plan and off-site parking plan, including
accessible parking, will be developed through public process and approved by
city staff prior to fmalization of the vacation.
Section 2. The commission further recommends that this vacation be rescinded if an
alternative other than Alternative 2A is constructed.
Section 3. This resolution shall take effect immediately upon its adoption.
