Castellina moved to approve the Consent Calendar; the motion was seconded by Shaw. Shaw moved to amend the main motion by adding Item A. to the Consent Calendar; the motion was seconded by Kowalski. Sutherland stated that a vote on the amendment would carry the main motion. The question was called and the Consent Calendar was approved as amended by unanimous vote. The following item was noted for information: A. January 6,1993, memorandum from Engineering & Utilities Manager Diener regarding a request for a Corps of Engineers permit to build a dock at Adams Street. 8. PRESENTATIONS WITH PRIOR NOTICE None 9. PUBLIC HEARINGS A. Notice of public hearing as posted and published as required by law concerning the proposed small boat harbor master plan was noted and the public hearing was opened. Cornelia Daly, 335 Ballaine, stated that she was concerned about not knowing the time frame for development of a harbor across the bay or expansion of the existing small boat harbor. She asked for a status report on the Small Boat Harbor expansion and the possible development of a harbor at Nash Road. She asked where the development would. take place. Sutherland asked Martin to review the master plan at this time. Martin stated that a permit application for development of the Nash Road Harbor was essentially complete but was sent back to the Corps of Engineers for minor wording changes. He reported that it would be possible to obtain the permit within the next two weeks. He stated that the environmental assessment, completed 10 years ago, was still in effect. He added that, once the permit was received, the council would determine how the Nash Road Harbor would be developed, either by leasing tidelands or deeding property to a private developer, or having the city develop a new harbor. He stated that, if the project were developed privately, the city would be approached about providing the installation of sewer and water lines and extending electrical service to the area. He noted that it would cost in excess of one million dollars to provide the infrastructure needed to accomodate a new harbor. Carpenter replied that a draft was currently before the Commission and it needed more review before recom- mending approval to the City Council.. Martin explained that the Council wanted to move the plan through at a fast pace. He stated that he had gotten ahead of his own schedule in bringing a resolution to the Commission at this time. He noted that he needed more time to submit the draft plan to lessees in the area, the yacht club and other city boards and commissions before recommending a revised plan to the Planning Commission in February. He stated that his goal was to formulate a revised plan from the draft plan after receiving input from the communil..y. Martin asked for a consensus from the Commission about different issues, such as making more land available, expanding into the tidelands and parking issues. Carpenter moved to postpone action until the February 3rd meeting; the motion was seconded by Kowalski and carried by unanimous vote. B. Copies having been made available to the public, Sutherland noted by title only a resolution entitled: A Resolution of the Seward Planning and Zoning Commission recom- mending that the City Council enact Ordinance No. 93-03, amending Chapter 12.10, Signs, of the Seward City Code Carpenter moved to approve Resolution No. 93-002: the motion was seconded by Castellina. Martin stated that approval of this ordinance would allow illuminated signs in the city. He stated that the Commission would be responsible for deciding whether or not to issue a sign permit if someone wanted to install a time and temperature readout sign. Sutherland asked about the height requirement of a free standing sign. Martin replied that the sign could be no taller than the building. The question was called, and Resolution No. 93-002was approved by unanimous vote. 11. UNFINISHED BUSINESS A. Review of Land Uses Allowed Table and Definitions. CALL TO ORDER The February 3, 1993, regular meeting of the Seward Planning and Zoning Commission was called to order at 7:30 p.m. by Chairman Donald Sutherland. 2. He noted that the boardwalk shops, which had not been constructed according to the building code, should be brought into compliance. He suggested that the tidelands should be maintained for public use only until existing upland lease sites were fully developed and parking availability was resolved. He recom- mended a thorough evaluation before development of any tidelands. He stated that, due to the limited availability of land space in the harbor, the abandoned and derelict vessels should be relocated to the east or across the bay. He noted that the harbormaster's building needed to be relocated or expanded to ensure a view of overall harbor operations. He stated that land development should also be coordinated with the Alaska Railroad, the only other land owner within the harbor. Martin reviewed the transportation facilities, including parking issues; street access; pedestrian traffic; parking areas for loading or offloading and bus, taxi and trolley zones. Martin noted the need for additional restrooms, public telephones, public showers, and street lighting. He noted that the need for a seamen's center to accommodate out-of- town fishing and merchant vessel crew members had been discussed. Martin reported on various public safety issues that needed to be addressed including identification of safety hazards, environmental issues, the location of the Coast Guard Cutter in relation to quick response and close monitoring of the float plane landing area. He stated that the area south of the harbor, where the Harbor Lights Apartments were located, should continue to be restricted for development because of its location within a tsunami run-up area. Martin summed up his presentation by addressing the appearance of the harbor and methods to implement the small boat harbor management plan. A. BRAD SNOWDEN, 525 Sixth Avenue, voiced various concerns relating to the plan including results of the feasibility study, the possibility of halting development because some landowners chose not to develop their property, fee rates for boat storage, develop- ment of the boardwalk area, limits on building height and other issues. He asked the Commission to allow more time to fine-tune the plan before recommending it for approval to the Council. DON WITHROW, Small Boat Harbor, thanked Martin for devoting so much of his time in preparing the plan and allowing the public to voice opinions. The meeting was recessed at 9:28 p.m. and reconvened at 9:35 p.m. 12. NEW BUSINESS 13. ADMINISTRATION REPORTS Martin welcomed Carpenter to another term on the Commission. He stated that Michael Olson had been appointed to the other vacancy but had withdrawn due to a conflict with his profession as a journalist. He stated that Elaine Nelson had submitted an application which would be considered at the Council Meeting on Monday. Martin further stated that former Commissioner Thome had reapplied and that he he still represented the city as a member of the Borough Planning Commission. He noted that, in July, Thome's seat on the Borough PlalUling Commission would expire. He stated that, at that time, Mayor Crane could recommend a city representative to fill the seat. Martin reported that the Council had approved the ordinance that allowed the installation of time-and-temperature signs. He stated that the parking lot in the Small Boat Harbor located next to Four Seasons Boat Care had been sublet to Major Marine to operate a salmon bake in the summer. He noted that this would require a conditional use permit. Martin reported that, according to the economic study performed by Ogden Beeman, a stand-alone cruise ship dock was not economically feasible. He also reported that the city had received a proposal requesting permission to operate a mobile business on city property. He stated that this proposal would need to be considered by the council in the near future. In answer to a question about the upcoming seminar for Planning Commissioners, those present stated that they would attend the seminar. 14. COMMISSION DISCUSSION Bardarson stated that the Commission should address the zero-lot-line issue in the harbor. He also stated that the Commission should make a recommendation to Council regarding the proposed single-use dock. He noted for the record that he was against construction of this proposed dock. He also noted that the city should review the . military recreation camp location and detennine whether or not that land could be put to better use, perhaps as an additional subdivision to provide more housing. Castellina asked about the status of the Corps of Engineers permit for the proposed Nash Road Harbor. Martin replied that a preliminary permit had been received. 15. CITIZENS' DISCUSSION None. Bardarson stated that water, sewer, and restrooms were not addressed in the report. Nelson stated that restroorns ha.d been a major issue in the Small Boat Harbor Management Plan and could not be ignored. Martin stated that, since writing the memorandum, he had given this issue more thought. He noted that the requested conditional use permit site was situated on a site granted a Conditional Use Permit in 1989 for construction of four buildings with specific heights and sizes with construction of the buildings and boardwalk to be phased in over a 2-year period. He noted that, thus far, only two of the buildings and the boardwalk had been completed. He stated that there was some question as to whether the original permit required construction of the four specific buildings in order to remain valid. In addition, there was some question regarding how this request would fit within the scope of the original permit. Martin stated that a letter from Sandefur (original permittee) had been distributed to the Commission requesting an extension of her permit until spring, 1995, and approval of this temporary business for the coming season. She had also requested that the salmon bake restaurant be allowed to extend above the 21 ft. height restriction contained in her original permit, that the restaurant be considered a substitute for the remaining two buildings which had not been constructed, and that she be allowed to construct additions to her existing two buildings. Martin stated that the other issue to consider was the request to operate the business from a tent during the first season. He noted that the Land Use Table referenced a temporary or mobile building for office/security purposes; however, tents were not included. In addition, this use did not meet the unlisted uses criteria set forth in the Code. He stated that the administration could not recommend a permit for the temporary structure; however, it did recommend granting a permit for the restaurant. Martin added that the Commission could not take action on Sandefur's permit questions at this time; however, this issue would be scheduled for consideration at the April meeting. Bardarson stated that he was concerned about the lack of sanitary facilities and added that a salmon bake business had been operated in the harbor several years ago, but it had been adjacent to a building with all necessary facilities in place. Martin noted that Section 1 of the resolution should be deleted. Castellina noted that, even if designated within the Park Zone, the city could continue to allow camping on the property. Sturdy noted that this plan would be presented to the Commission again on April 3rd and would be presented to the Council for approval after receiving the Commission's recommendation. C. Proposed Forest Service Mount Alice Trail. Martin stated that the Forest Service was ready to move forward with this project contingent upon receiving city concurrence and a permit from the city allowing the trail to cross city property. Castellina moved to recommend that the City Council grant concurrence for the Forest Service to construct a trail to Mt. Alice, the motion was seconded by Shaw and carried by unanimous vote. D. Long term lease request by Tanya Sandefur (Lot 1. Block 2. Marina Subdivision). Carpenter moved to recommend that the Council approve Tanya Sandefur's request for a long term lease of Lot I, Block 2, Marina Subdivision; the motion was seconded by Castellina. Bardarson noted that this project would be in direct competition with his business and asked if he had a conflict of interest. Sutherland stated that he did not believe a conflict existed. Bardarson noted that this was too valuable a piece of property to use for boat storage. Castellina stated that the harbor was originally built for boaters and boats, and the city could not continue to push the boats and boaters away from the harbor. The question was called, and the motion was approved with Carpenter, Castellina, Nelson and Sutherland voting YES and Bardarson and Shaw voting NO. E. RV Park Development at 310 Van Buren Street Martin stated that a number of years ago, Jim McCracken and Dale Clemens had obtained a conditional use permit for operation of an RV Park and winter boat storage. He stated that, at that time, the applicants had wanted to use a parcel of city property adjacent to the project, and the permit had stated that this particular piece of city property could be not be used to generate income. Martin noted that the RV Park covered two private lots and three city lots (induding the lot with restricted use), and recently McCracken had been informed by the owner of the privately-owned parcels that this property had been leased to another individual effective May 1993. Martin stated that, since the original permit had been issued for one RV Park to cover all. of the parcels, the city must decide whether this division of the property and the potential now for two separately operated Parks would: (1) negate the original permit; (2) apply to only one of the operators; or (3) continue to cover both operations. He stated that he was not out to hurt the public by affecting single-family residences in the area. MIKE BRITTAIN, 231 Ballaine, stated that he agreed with the project but not the location. He voiced his concern about diagonal parking along Ballaine and on the park strip. He stated that most of the block was primarily residential which required on-site parking and he was concerned about the effect on the future value of adjacent property. DAVID DIECKGRAEFF, 236 Sixth Avenue, stated that this was a good project but not the appropriate place to build. He noted that there was already considerable traffic in the area and he did not want to see any traffic using the alley. DALE LINDSEY, 704 First Avenue, stated that he was the current owner and seller of the property to be developed. He stated that, initially, he planned to build an office building at 221 Ballaine. He further stated that Seward was a small town with strict parking regulations. As an example, he cited that 60 parking spaces would have been required for an office building where only 13 people were employed. He encouraged the Commission to look at Seward as a small town and make future decisions accordingly. NINA DALEY, 235 Ballaine, spoke on behalf of Mark Kansteiner, owner of the house where she lived. She objected to amending the parking ordinance to accommo- date this project. She stated that the neighborhood was residential and included five single-family homes and one apartment complex. She noted that this was a great project, but it should be built elsewhere. JIM MC CRACKEN, Lowell Point, stated that this project was the cornerstone of revitalization of the downtown area. He fully supported the development at this time and suggested that the community think about the changes that would be made to accommodate the upcoming Sea Life Center project. No one else appeared in order to be heard and the public hearing was closed. 10. RESOLUTIONS A. The Commission agreed with Sutherland's recommendation. YANEZ commended Martin on his efforts in the past and stated that he would take the request for extra help into consideration. He explained that, although citizens could not always proceed with projects the way they hoped, Martin had an obligation to comply with the City Code and regulations in order to present facts and options to the public. 9. CITIZENS' DISCUSSION NINA DALEY, 235 Ballaine, emphasized that she was not against development and she thought that development and parking issues should be considered for the entire downtown area to include all businesses. She stated that, if Seward were to increase its commercial lodging capacity, it was time to formulate a plan for hotel parking in one area downtown, not several separate areas. She also stated that she was disturbed that the Commission recommended the waiver of certain zoning requirements on the last vacant property on the block when everyone else had invested their time and money based on current zoning requirements. SUTHERLAND, in response, asked Daley is she would be willing to serve on a parking committee to assist Martin. She replied that she would be glad to. CARL NORMAN, Bear Lake Road, stated that this project seemed to be out of focus to some people. He noted that, when the Alaska Sea Life Center was built, the entire downtown area would need to be restructured and now was the time to begin planning, not later. He added that this was not the best place to build a hotel. NINA DALEY, 235 Ballaine, stated that she did not feel that anyone was against development, but it needs to be done responsibly. She noted that the problem with extending the Central Business District was that there were no requirements for parking or setbacks. She added that there were already concerns about parking problems downtown. She stated that the project should be built with parking areas on-site. W ALTER CHRISTO LEAR, 335 First A venue, recommended that the city pave the Waterfront area south of town and make it into a parking lot. He stated that the Normans were providing parking but there would continue to be parking problems. He further stated that, when the Sea Life Center was built, property values would increase. No one else appeared in order to be heard, and the public hearing was closed. C. Parks and Recreation Master Plan. Parks and Recreation Director Sturdy distributed replacement pages (10 and 13) to the plan for the Commission's review. Sutherland opened the public hearing. NINA DALEY, 235 Ballaine, stated that she was concerned about an area north of the Wellington Pavilion where a deep depression in the ground fills with water. She was concerned about safety issues because children play in that area. CRAIG TURNBULL, Camelot Drive, spoke on behalf of the Seward Little League Board. He stated that the board encouraged development of a ball field behind the elementary school. He noted that there was not enough playing room now and more fields were needed. He voiced opposition to closing Boulder Stadium if a ball field could not be built at the school site. MARK KANSTEINER, 235 Ballaine, agreed that it was a good idea to extend the grassy area to the south to the location of the memorials. SAM YOUNG, Primrose, representing the Seward Trails Council, was glad to see that a Park Plan was created by the Parks and Recreation Dept. He stated that he hoped to see the projects happen because grant funds were available for the proposed projects. He noted that he fully supported a plan which would provide increased winter activity. He stated that Nonnan was required to scale down the original project in order to meet current requirements, and, if the property were rezoned, Nonnan could enlarge his project since he would not be required to provide parking. Nelson acknowledged considerable input from businesses and people in the community. She stated that, although the community could benefit from this business, she was concerned with rezoning since there would be no parking and setback require- ments. She noted that this would negatively affect the city regarding safety for locals and tourists. She stated that the city could not rely on the Sea Life Center project to provide parking until it was actually built. Castellina stated that she favored the project, but not the proposed area for which it was planned. She further stated that she was against spot rezoning. Kowalski stated that the Commission had asked the Council to direct Martin to amend the parking ordinance. She added that she was opposed to rezoning and had specifically requested that this area not be rezoned to Central Business District. Sutherland stated that many pros and cons had been raised regarding parking, zoning, specific land use and the potential Sea Life Center project. He stated that it was unlikely that parking would be provided at the Sea Life Center for buses only and not other vehicles. He noted that a parking garage would be needed to accommodate the proposed project. He stated that the public perceived that parking downtown was scarce and becoming more scarce. Sandefur further requested that the time frame for building on the property not be restricted because she wanted to expand at a later date when she had the necessary funds. She stated that the completion date of April 1995 was okay for construction of the restaurant proposed by Major Marine Tours (the party subleasing a portion of her leased property). The Commission agreed to lift the deadline for building on the property (by Sandefur) except that the completion date would remain intact for Major Marine Tours. Bardarson moved to amend the resolution by deleting Section l(b), renumbering the remaining sections accordingly, amending new Section 1(b) to read: The proposed restaurant building may not exceed two stories in height, and the building plans must be approved by the Planning Commission prior to construction of the building, and amending Section l(c) by deleting fifth and replacing it with sixth; the motion was seconded by Nelson. He stated that, although the request for a tent had been denied, the concept of a restaurant was approved with the stipulation that the building design be brought before the Commission for review and approval. He stated that Mr. Jackson from Major Marine was present in the audience to answer any questions. Bardarson moved to approve the preliminary drawings for the restaurant with the understanding that the final plans would be brought back for approval before construction; the motion was seconded by Nelson. He noted that it was good to be back in Seward after an extended period of absence. He objected to constructing high buildings in the Small Boat Harbor. He stated that downtown construction should be encouraged and buildings in the harbor should be restricted to marine related facilities. CARL NORMAN, Bear Lake Road, noted that he was sorry to hear the Commission's vote of disapproval on rezoning. He stated that he had also lost another 10 feet of property due to the recommendation of an ordinance to change setback requirements. He felt that he had run against a brick wall in his project but there were other projects approved with no consideration given on parking issues. DAVID DIECKGRAEFF, 236 Sixth Avenue, stated that he was glad to see the public process work. He suggested looking at the subdivisions in the city and planning for proper sidewalks, gutters and drainage areas. He cited Gateway as a poorly planned subdivision. MARK KANSTEINER, 235 Ballaine, stated that be was sorry for not being in town earlier to testify on the proposed rezone, but he appreciated the vote of confidence for the small family residence. He favored another location for the Normans to build their proj ecl. NINA DALEY, 235 Ballaine, stated that she was sorry to hear if the setbacks would take 10 feet from the Normans' property. She noted that the reason environmen- tal people were fighting funding of the Sea Life Center was that the money should go for restoration and rehabilitation of land damaged by the oil spill. She stated that some of the public viewed the Sea Life Center as a tourist-trap-related project. She stated that more emphasis should be focused on the rehabilitation and education aspect of the Center rather than the "tourist-trap" aquarium. 16. COMMISSION & ADMINISTRATION RESPONSE TO CITIZENS' COM- MENTS CASTELLINA agreed with Daley's comments about the Alaska Sea Life Center. She stated that Seward was the only community whose beaches were actually oiled from the oil spill. She agreed that rehabilitation and research should be emphasized by the community during its lobbying efforts for the Sea Life Center. She stated that it was important to preserve the remaining marine life in the area, and she noted that, during a recent survey taken in Resurrection Bay, only 300 sea lions were counted, as opposed to over 1,000 in the past. She stated that the recent episode of the dying murre was a prime reason to develop a rehabilitation and. research center in Alaska because the birds had been taken to Wisconsin for research. She added that a rehabilitation, research and education facility would benefit the state and the community. RESOLUTIONS A. The proposed resolution entitled: A Resolution of the Seward Planning and Zoning Commis- sion recommending adoption of proposed OrdInance No. 93- 1Q, amending the Seward Zoning Code fi 15.10.225, Land Uses Allowed was DELETED from the agenda. B. Copies having been made available to the public, Bardarson noted by title only a proposed resolution entitled: A Resolution of the Seward Planning and Zoning Commis- sion approving a conditional use permit to Brad Snowden for construction and operation of a hotel in the Small Boat Harbor within Block 6, Oceanview Subdivision. Kowalski moved to approve Resolution No. 93-012; the motion was seconded by Nelson. Nelson stated that Snowden had contacted her and had answered some of her questions regarding his proposal. She stated that it was her understanding that the hotel would be built where the boat repair business was currently located and would not represent a loss of parking. Carpenter stated that Snowden had also contacted him and he had visited the site with him. Carpenter suggested postponing this resolution until Snowden could be present and added that Snowden had indicated to him that postponement would not be a problem. Nelson stated that there were questions put forth in the city's memorandum which she would like for Snowden to answer prior to the next meeting. Kowalski stated that there must be a higher and better use for such prime property than boat storage and repair. Martin stated that he had talked to Snowden yesterday and had been told that further negotiations with the Alaska Railroad was contingent upon his obtaining a conditional use permit. CITIZENS' DISCUSSION SUE KAANTA, 318 Sixth Avenue, asked the Commission to consider all aspects of the Small Boat Harbor Master Plan before granting a conditional use permit to Snowden. TANYA SANDEFUR, Small Boat Harbor, stated that, if approved, Snowden's conditional use permit should require that he extend the boardwalk along his lease site. She added that the Commission should also restrict the height of the building and require Snowden to provide on-site parking. 16. PRESENTATIONS WITH PRIOR NOTICE None 9. PUBLIC HEARINGS A. Conditional Use Permit for construction and operation of a hotel within the Small Boat Harbor (Block 6. Oceanview Subdivision -1412Fourth Avenue) as filed by Brad Snowden. Notice of public hearing as published and posted as required by law wa noted, and the public hearing was opened. BRAD SNOWDEN (applicant), 525 Sixth Avenue, briefly reviewed his plans. He noted that parking seemed to be the main concern expressed by those objecting to the construction of the hotel and explained that his project would result in a net gain of 78 parking spaces which could be used by the general public from 6:00 a.m. until 6:00 p.m. each day. JOHN BURNS, Director of Facilities and Land Development for the Alaska Railroad, stated that the Railroad, as owners of the subject property, fully supported Snowden's request for a Conditional Use Permit. Burns noted the Railroad's plans to realign the roadway to facilitate better use of the limited land available within the harbor and to provide improved pedestrian access for Alaska Railroad passengers. He further noted that, in the short term, ARR planned to relocate boat storage from the lease site to a larger piece of property which would be created by the realignment of the road. Burns stated that, if passenger service to Seward continued to grow at its present rate, the Railroad would be forced to relocate the passenger depot to a site on the North side of Port Road within the next two to three years. NINA DALY, 235 Ballaine Boulevard, read a letter from Tanya Sandefur objecting to the construction of the hotel. SUE KAANTA, 318 Sixth Avenue, asked if the city had reviewed the use of multi- story buildings along the shoreline. When she found that this review had not taken place, she asked that the height limits be studied and that height limitations be imposed which would preserve a view of the harbor from the highway. No one else appeared in order to be heard, and the public hearing was closed. 10. Martin noted that a condition of the permit issued to Ron Mager to construct a restaurant in the Small Boat Harbor was that he present his updated plans for construction to the Commission for review. He noted that the drawings and plans were displayed in Council Chambers. There was no objection from the Commission to the plans as presented. Deferred to a work session to follow the dose of regular business. 12. NEW BUSINESS A. Request by Vicki Seigel to allow replat of Lot F, Forest Acres Subdivision. Martin noted that Seigel owned a 29,000 s.f. lot in the Forest Acres Subdivision which she had been unable to market. She was, therefore, requesting the minimum lot size (20,000 s.f.) within the subdivision be set aside to allow her to subdivide her lot into two lots of 14,500 s.f. each. The Commission instructed Martin to notify Ms. Seigel that the minimum lot size was a City Code requirement which could only be changed by ordinance of the City Council and could not be set aside for one lot only. 13. ADMINISTRATION REPORTS MARTIN noted that Councilmember Krasnansky had asked that the Commission consider a review of the zoning code as it related to kennels and the possibility of raising the maximum number of dogs allowed on lots not designated dog kennels. MARTIN also noted that the Council had appropriated funds for the state to proceed with the transfer of SMIC tidelands to the city. 14. MARTIN noted for information a proposed subdivision plat splitting the Margaret Deck property in Jesse Lee Heights into two lots. MARTIN distributed a letter from the Historic Preservation Office noting that it anticipated receiving $350,000 of federal funds for Fiscal Year 1994. He asked if the Commission was interested in pursuing any of these matching funds for city projects. Martin noted that the moneys could be funneled through the city to a private group or owner for private development of historic properties or to assist in applying for a place on the historic register. Sutherland noted that the Railroad Depot would probably have to be moved when the SAAMS project was developed. Martin stated that it would not necessarily have to be moved; however, it could be moved without losing its historic building designation. He also noted the possibility that the building could be used as a passenger depot once the Alaska Railroad relocated the rail in the Small Boat Harbor. MARTIN noted that Phase I of the Historic Plan was "so far out of kilter" that there was really "no hope" for it. He indicated that the contractor had failed to present the final plan which was due yesterday. He stated that he did not think it was possible to have a completed document in the state office in time to meet the state deadline. Martin stated that neither Phase II nor the Jesse Lee Home Plans had been completed and he questioned whether he would submit them since they were for matching grants, not reimbursable funds. MARTIN asked the Commission if it had any interest in breaking into committees to work on individual pieces of the Zoning Code. COMMISSION DISCUSSION NELSON stated that she would like to see the Commission finish this project before tackling another. She stated that she would be willing to donate some personal time just to get it accomplished. CARPENTER agreed. He stated that he did not object to meeting in small groups, but he felt that Martin's input was needed. He stated that he would be glad to donate a couple of full days at a retreat to complete this project. SUTHERLAND stated that the Commission had been working on this project nearly two years. Martin reviewed a discussion he had with Brad Snowden clarifying the conditions that were to be met under Snowden's conditional use permit prior to construction of the hotel. He stated that Snowden was negotiating with the Alaska Railroad for lease of property, and Snowden planned to present his proposal to the Railroad Board in November. NEW BUSINESS Plat review and city letter to the Borough Planning Commission regarding KPB 93-138. Goreson-Carlson Replat, Laubner Addition. Martin stated that the Borough staff report recommended against vacation of the alley north of Van Buren and half of the alley right-of-way south of Van Buren. He noted that, due to the recommendations, the Borough Planning Commission had postponed action on the requested vacation until the Seward Planning & Zoning Commission had a chance to review the facts. Martin reviewed the history of the property and recommended vacation of the Van Buren Street right-of-way and the east half of the alley right-of-way associated with Lots 1-3, Block 3, and Lots 19-20, Block 11, Laubner Addition. Martin recommended against vacating Lots 21-22, Block 11, Laubner Addition, because these lots were identified as an inholding within the Two Lakes Park. He noted that the City had been given the highest priority for possible funding by a Land and Water Conservation Grant for land acquisition for the park. Unanimous Norman Subdivision Plat Review. Martin reviewed the proposed plat related to the Norman Subdivision outside of the city. He stated that he had clarified certain issues regarding names, right-of-ways and easements before the Borough Planning Commission took action on this item. He explained that no action was necessary on this item. Spring Creek Plat Review. Martin reviewed his comments related to the Borough proposed plat of the Fourth of July Creek area. He clarified that the subdivision should be named 4th of July Creek Subdivision rather than Phase I Spring Creek Correctional Facility. He clarified that Tract C was a dedicated easement and not a public right-of- way. He noted, once again, that no action was necessary on this item. She noted that she had been working with Martin on the historic preservation plan and agreed that it was time to move forward with historic preservation in Seward. Without Objection Review of Alaska Railroad alternative proposal to B Street Dock development. Bardarson stated that he had looked at both proposals and had noted several advantages to each. He noted that the Alaska Railroad Dock would probably be more fully utilized; would eliminate the need to duplicate infrastructure; would require less city involvement and would eliminate liability to the city; would eliminate the need to increase city government to handle the extra responsibilities; if run by Northern Stevedoring, would leave ship handling in the private sector; would not displace current users of Waterfront Park; would not eliminate a current revenue source (campers); would not conflict with the possible need for SAAMS parking; would not interfere with navigation in the existing small boat harbor; would help maintain the current character of Sewardj would not obstruct the view of residentsj would not create additional traffic problems; would not interfere with the bike path; and would increase the state's vested interest in Seward. According to Poleske, Wada was hired to blaze what eventually became the Iditarod Trail. Martin suggested that another appropriate name might be Kawabe Creek in recognition of Harry Kawabe, a Seward businessman from 1906 until 1941, or Obihiro Creek in honor of Seward's Sister City, or, perhaps, Kushiro Creek in honor of Seward's Sister Port. Kowalski stated that she would prefer Kawabe Creek. She noted that Mr. Kawabe had established the on-going Kawabe scholarship at the high school. She added that she would not object to Japanese Creek. Sutherland concurred with Kowalski's proposal that the name be changed to Kawabe Creek. Castellina stated that this would be a good project for the new historical commission to assume as one of its first orders of business. She stated that the commission could conduct a popular vote and use this as a chance to educate the town about Seward's history. Carpenter stated that he preferred Japanese Creek. He noted that people would probably continue to call the creek by its original name Oap Creek), and added that, if the city was going to maintain any kind of historical perspective, it should leave the name as close to the original as possible. Bardarson stated that it should remain Jap Creek. He stated that to rename it Japanese Creek and have everyone continue to call it Jap Creek did not make any sense. MOTION (Carpenter/Kowalski) Concur with the federal government's decision to change the name of Jap Creek to Japanese Creek. Motion Passed. Unanimous Discussion of effects of mall/discount stores on the local economy. Following lengthy discussion regarding the economic and visual impacts chain stores and malls could potentially have on the city of Seward, Bardarson instructed Martin to look into the Commission's options if the city wished to keep chain stores from locating in Seward. CITIZENS' DISCUSSION COUNCILMEMBER MARGARET ANDERSON stated that she was still working towards scheduling a joint CounciVCommission work session. She stated that she also intended to ask that the Planning Department staff be increased to better meet the city's planning needs, and she suggested that calls to individual councilmembers from others in the community would help accomplish this end. Anderson stated that the city must recognize the need for long range planning. She also noted that, on December 14th, at 5:30 p.m., the Council would meet with University of Alaska Community Development Specialist Larry Dickerson to discuss the development of a partnership for Seward's future, and she urged commission members to attend. ANDERSON expressed some concern about the direction the city was taking regarding its need to maximize potential revenue sources. She also noted that ARR Vice President Bums would be in town on Friday to address plans for the Alaska Railroad Dock before the Chamber of Commerce. CAROL CLARK, 1129 Park Place, noted that she had lived in Edmonds, Washington, a town that had made an extra effort to maintain its small town character. She stated that it was important that the community determine a direction or plan for the city. She also urged the city to closely scrutinize the SAAMS project before these plans were finalized to avoid the construction of a facility that would not fit with the look of Seward. MIKE WILEY, 550 Railway, took issue with the Commission's decision regarding lap Creek. He also stated that he was very supportive of plans to make downtown a historical area, but warned that no good would come from attempts to restrict growth and discriminate against one business over another. He stated that it was possible to preserve the historic character of Seward without restricting the growth of business and claimed that such protectionism was un-American. ARLENE WILEY, 550 Railway, stated that the Kenai Peninsula Tourism Marketing Council would meet on the 14th and 15th of December at the Kenai Princess Lodge to discuss blending tourism and the local economy. She noted that both bed and head taxes would be addressed.
