RESOLUTION NO. 98-074
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, RECOMMENDING TO THE KENAI PENINSULA BOROUGH TO
APPROVE AN ABBREVIATED PLAT TO SHIFT THE PROPERTY LINE
BETWEEN LOTS 1 AND 2 WATERFRONT TRACTS EASTERLY 25 FEET
TO PLACE ALL OF THE HISTORIC HOBEN PARK WITHIN LOT 2
WATERFRONT TRACTS
WHEREAS, the original "Waterfront Tracts" survey included six tracts; and
WHEREAS, tracts 1,2,3 and 4 were developed as the Institute of Marine Science, teen center
and warehouse; and
WHEREAS, the old ferry dock, historic depot building and Hoben Park were noted on the
survey but not included in it; and
WHEREAS, in order to accommodate the land lease to the Seward Association for the
Advancement of Marine Science (SAAMS) for the Alaska Sea Life Center, in 1997 the tracts were
replatted; and
WHEREAS, the depot and park areas were included as two separate surveyed lots; and
WHEREAS, there was a communications gap between the City and the surveyor and some
of what was the historic park was included in Lot 1 (the depot building site) which was subsequently
leased to Chugach Development Corporation; and
WHEREAS, the City and Chugach are jointly amending that lease agreement; and
WHEREAS, Chugach is willing to allow their westerly property line to be moved about 2
feet to place all of what has historically been recognized as part of the park into a new lot; and
WHEREAS, Seward City Code 16.01.015B states that no preliminary plat of city-owned
lands may be submitted to the Kenai Peninsula Borough planning commission for approval without
prior consent of the city council; and
WHEREAS, as a simple shift of an internal property line, the borough will be able to handle
this plat administratively under what is called an abbreviated plat procedure:

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, that:
Section 1. The City Council submit to the Kenai Peninsula Borough for approval an
abbreviated plat to shift the property line between Lots 1 and 2 Waterfront Tracts easterly 25 feet
to place all of the Historic Hoben Park within Lot 2 Waterfront Tracts.
Section 2. This resolution shall take effect immediately upon its adoption.
PASSED AND APPROVED by the City Council of the city of Seward, Alaska, this 13th
day ofJuly, 1998.
