HomeMy WebLinkAboutOrd1999-006 I I I Sponsored by: Reilly Introduction Date: Aori126, 1999 Public Hearing Date: May 10, 1999 Enactment date: May 10, 1999 CITY OF SEWARD, ALASKA ORDINANCE NO. 99-06 AN ORDINANCE AMENDING SEWARD CITY CODE, CHAPTER 8.20, VEHICLES FOR HIRE BY EXPANDING THE DEFINITION OF "VEIDCLE" TO INCLUDE ANY FORM OF CHA UFFEURED PASSENGER TRANSPORTATION WHEREAS, currently our city code limits the use of horse drawn carriages within the City of Seward; and WHEREAS, the Seward City Council approved a special events permit for a horse drawn carriage in December 1998 for the Christmas train and the Polar Bear Jump; and WHEREAS, there have been several request for licenses for similar businesses; and WHEREAS, in order to limit the City of Seward's risk, these businesses should follow the same requirements as other vehicles for hire; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, that: Section 1. Seward City Code Chapter 8.20, Vehicle for Hire, footnote number 7 is hereby amended to read as follows: See AS 29.35,060 for state provisions allowing municipalities to grant franchises and permits; see Title 11 of this code as to vehicle traffic regulations generally; see ~ 15.20, as to signs on vehicles for hire. Section 2. Seward City Code Chapter 8.20.010, Definition and scope, is hereby amended to read as follows: A. As used in Chapter 8.20: 1. "Vehicle" means a device in, upon, or by which a person or property may be transported or drawn upon or immediately over a highway or vehicular way or area; "vehicle" does not include (I) devices used exclusively upon stationary rails or tracks, or (ii) mobile homes. 2. "Vehicle for hire" means any form of chauffeured passenger transportation offered for hire. CITY OF SEWARD, ALASKA ORDINANCE NO. 99-06 B. This chapter shall not apply to any vehicle for hire which is regulated by the state. (Ord. 533, 1985; Ord. 94-55) Section 3. Seward City Code Chapter 8.20.020, Permit required, is hereby amended to read as follows: A. No person may provide a vehicle for hire as provided by this chapter unless that person is a permit holder in possession of a valid vehicle for hire permit issued to him under this chapter. Section 4. Seward City Code Chapter 8.20.030, Permit fees, is hereby amended to read as follows: Each permit holder shall pay an annual fee of one hundred dollars ($100.00) per vehicle. This fee is due upon application for a new permit, and thereafter is due and payable on the second day of January annually. (Ord. 530, 1985) Section 5. Seward City Code Chapter 8.20.055, Records, is hereby amended to read as follows: A. Each permit holder shall maintain a current and accurate daily list for the vehicle for hire operated pursuant to his permit. Such list shall include: 1. the name, address, telephone number, license number and expiration date for each chauffeur operating such vehicle for hire; 2. the dates of hire and termination for each chauffeur operating such vehicle for hire; 3. the daily hours worked by each chauffeur operating such vehicle for hire; 4. the number of daily hours such vehicle for hire is operated during each calendar month; 5. the time and place of passenger pickup and delivery, the number of passengers, the amount of fare received, the time of the call for service and the name and license number of the chauffeur responding to that call; 6. the name, address and telephone number of each establishment under contract for vehicle for hire and the dates and times of each pickup and delivery performed under said contract(s). B. The records maintained pursuant to subsection A. of this section as well as any other records related to the operation of the permit shall be retained by the permit holder for at least two years and shall be made available upon request of the city or a police officer. The city may request that the permit holder forward the records to the city on a monthly basis. I I I CITY OF SEWARD, ALASKA ORDINANCE NO. 99-06 (Ord. 530, 1985) Section 6. Seward City Code Chapter 8.20.060, Terminals and zones generally, is hereby amended to read as follows: No person may operate a vehicle for hire unless from bus stops, loading zones, common carrier zones or from a terminal. A "terminal" is defmed as a privately owned station or depot from which vehicles for hire may operate. A "zone" is defmed as a single parking space on a city street. (See ~ 11.15.110) (Ord. 530, 1985; Ord. 612, ~ 12, 1989) Section 7. Seward City Code Chapter 8.20, Vehicle for Hire, footnote number 9 is hereby amended to read as follows: See ~ 11.15.110 et seq. as to the police chief's designation of bus stops, loading zones, or common carrier zones. Section 8. This ordinance shall take effect ten (10) days after enactment.
