CITY OF SEWARD, ALASKA
ORDINANCE NO. 439
AN ORDINANCE RELATING TO THE HARBOR COMMISSION,
REPEALING AND RE-ENACTING SECTION 5-3
OF THE SEWARD CITY CODE
THE CITY OF SEWARD, ALASKA, ORDAINS:
Section 1. Section 5-3 of the Seward City Code is hereby repealed
and re-enacted to read as follows:
Section 5-3. Harbor Commission--Created, Composition, Appointment
of Chairman, Ex-Officio Members; Terms of Office, Filling Vacancy
in Office; Meetings, Quorum
a) Created, Composition, Appointment, Chairman, Ex-Officio Members:
There is hereby created a City Harbor Commission, consisting of
seven members, all of whom shall reside in the City and who shall be
nominated by the Mayor and confirmed by the Council. No officer or
employee of the City may be appointed as a member of the Commission.
A chairman of the Commission shall be selected annually and
shall be appointed from and by the appointed members.
The Mayor, City Manager and Harbor Master shall be ex-officio
members of the Commission and shall have the privilege of the floor
but not the right to vote.
b) Terms of Office, Filling Vacancy in Office:
Members of the Harbor Commission shall be appointed for two
year terms. The Mayor, with approval of the Council, may appoint
any qualified person to fill a vacancy of any member of the Commis-
sion; provided, that the appointment shall be for the unexpired term
of the vacancy.
c) Meetings, Quorum:
The Harbor Commission shall meet at 7:30 p.m. in the City
Council Chambers on the fourth Wednesday of each month. Special
meetings may be held at the call of the chairman and at such other
times as the Commission may determine. Four members of the Commis-
sion shall be a quorum for the transaction of business, except that,
in the absence of a quorum, any number less than a quorum may adjourn
the meeting to a later date. The affirmative votes of at least a
majority of those commissioners present shall be required for official
action, unless a larger majority is required by law. All meetings
and records of the Commission shall be open to the public. The
