CITY OF SEWARD, ALASKA
ORDINANCE NO. 440
AN ORDINANCE ESTABLISHING SERVICE FEES FOR THE SEWARD MUNICIPAL
SMALL BOAT HARBOR AND ITS FACILITIES, REPEALING SECTION 5-80.2,
GRID FEES, REPEALING AND RE-ENACTING SECTION 5-80.1 OF THE SEWARD CODE
THE CITY OF SEWARD, ALASKA ORDAINS:
Section 1. Section 5-80.2, Grid Fees, of the Seward City Code is
hereby repealed.
Section 2. Section 5-80.1, Service. Fees, of the Seward City Code
is hereby repealed and re-enacted to read as follows:
Sec. 5-80.1 Service Fees

(a) Service fees for the approved use of the Seward Municipal
Small Boat Harbor and its facilities shall be set by
Council resolution.
(b) Application for use of the grid and payment in full of the
charges shall be made prior to placing a vessel on the grid.
The Harbormaster may refuse permission for the use of the
grid, if, in his opinion, the grid is unsuitable for or may
be damaged by the vessel by the use to which the grid may be
put. The Harbormaster may direct the removal of a vessel
from the grid at any time.
(c) It shall be unlawful for a person to place a vessel on the
grid without advance permission of the Harbormaster.
(d) The Harbormaster may, at his discretion, require the posting
of a bond by a vessel owner before using the grid, to cover
the cost of repairing damages to the grid which may occur.
(e) Electrical Access Service:
Vessels mooring at slips having electrical power shall
connect to the electrical system.
(f) Meter Deposit:

A meter deposit shall be collected from any patron who
connects to the electrical power system.

(g) Ordinary services by harbor personnel may be rendered by
agreement with the Harbormaster. The charges for these
services shall be such as to compensate the City for time
and materials expended, plus reasonable overhead expenses.
The Harbormaster may require a deposit or payment in advance
of furnishing any ordinary services.
(h) Emergency services may be rendered by harbor personnel at
any time as necessary to prevent damage to persons and
property within the Small Boat Harbor. Charges for such
emergency services shall be assessed in the same manner
as ordinary services.
(i) Upland Storage:
(1) Upland storage on any harbor property owned by the City
shall be limited to the storage of boats, boats on trailers,
trailers or cradles and the rates for such storage shall
be set by the Council.
(2) Major construction work on vessels while in storage yards
shall be prohibited. Disagreements as to what constitutes
major construction shall be resolved by the Harbor Commis-
sion.

Section 3. This ordinance takes effect immediately upon enactment.

10th day of October, 1977.
