CITY OF SEWARD, ALASKA
ORDINANCE NO. 471
AN ORDINANCE RELATING TO THE SEWARD ADVISORY PLANNING AND ZONING
COMMISSION DECLARING AN EMERGENCY, AND REPEALING AND RE-ENACTING SECTIONS 2-66
AND SECTIONS 2-68 OF THE SEWARD CITY CODE
WHEREAS, the Seward Advisory Planning and Zoning Commission is presently required to
have nine seats, and
WHEREAS, the Commission is required to have five members present in order to have a
quorum for the conduct of public business, and
WHEREAS, the necessity of a five-member quorum is unreasonably burdensome in a City
such as Seward in which seasonal occupations require the periodic absence of a
substantial portion of its work force; and
WHEREAS, there are presently only four appointed members of the Commission presently
in town, and
WHEREAS, the conduct of public business by the Commission is not possible due to the
quorum requirements, and
WHEREAS, the City Council hereby finds that the inability of the Planning Commission
to function due to the lack of quorum constitutes a danger to the public health
welfare and safety by obstructing the consideration by the Commission of
important planning and zoning matters;
NO~ THEREFORE, THE CITY OF SEWARD, ALASKA ORDAINS:
Section 1. Section 2-66 of the Seward City Code is hereby repealed and
re-enacted to read as follows:
Section 2-66 Created; composition; appointment; chairman;
ex officio merr.bers. There is hereby created a city plan-
ning commission consisting of seven citizens, all of whom
shall reside in the City, and who shall be nominated by the
mayor and confirmed by the council. No officer or employee
of the City may be appointed member of the Commission.
A chairman of the commission shall be selected annually
and shall be appointed from and by the appointive members.
The mayor, city manager, city engineer and city building
inspector shall be exofficio melubers of the commmssion
and shall have the privilege of the floor but not the
right to vote.
Section 2. Section 2-68 of the Seward City Code is hereby repealed
and re-enacted to read as follows:
Section 2-68 Meetings and Quorum. The Planning Commission
shall meet at 7:30 p.m. in the Seward City Council Chambers
on the second Wednesday of each month. Special meetings may
