ORDINANCE NO. 487
AN ORDINANCE RELATING TO TEMPORARY HOLIDAY BUSINESSES
AND CREATING A NEW SECTION 16-10 OF THE SEWARD CITY CODE
WHEREAS, certain holidays and special events in Seward attract
large numbers of tourists; and
WHEREAS, service of those tourists as well as local residents
participating in local festivities requires greater short term specialty
business; and
WHEREAS, the Seward Chamber of Commerce is ideally suited to
monitor the businesses needed for these special times; and
WHEREAS, the "Transient Merchant Ordinance" (Article II of
Chapter 16) of the Seward City Code is not compatible with the general
commercial needs for these special times: and
WHEREAS, the City Council hereby declares that a state of
emergency exists in that his amendment is needed for the safe, and orderly
conduct of transient and temporary businesses on the next major holiday in
Seward but too little time exists for the adoption of the amending ordinance
in the normal ordinance adoption process.
NOW, THEREFORE, THE CITY OF SEWARD,ALASKA, ORDAINS:
Section 1. A new Section 16-10 of the Seward City Code is hereby
created to read as follows:
Section 16-10. Holiday and Special Events Exception.
(a) The provisions of Section 16-3 through 16-9 are not
applicable to a certificated business operated only during
the designated hours of a special exception holiday.
(b) The following definitions are applicable to this section:
(1) "Certificated business" means a business which has
received a certificate of authority to conduct a particular
temporary business during the designated hours of a special
exception holiday.
(2) "Designated hours of a special exception holiday"
means a time fixed by City Council resolution during which the
exception of paragraph (a) is made applicable.
(c) Not later than ten (10) days before the commencement of a
special exception holiday, a person seeking to conduct a tem-
porary business during such holiday shall make application for
a certificate of authority to the Seward Chamber of Commerce on

a completed application form containing the following information
and certificates, all of which are given under penalty of perjury:
(1) the name, address and telephone number of the applicant;
(2) a description of the temporary business in which applicant
seeks to engage during the designated hours of the special
exception holiday;
(3) the names and kinds of articles, commodities or services
which are desired to be sold;
(4) the location or locations where the applicant proposes to
operate such business;
(5) a certificate of the applicant's insurance carrier that the
applicant is insured under a public liability insurance policy
with policy limits per claimant of not less than $25,000 which
will be in force during the special exception holiday for which
application is made: and
(6) a statement that neither the owner nor the operator of the
proposed temporary business has had any claims of any kind filed
against him or them arising from the conduct of a business similar
to the proposed temporary business during the twenty-four (24)
month period immediately preceding the filing of the application.
The Seward Chamber of Commerce shall issue the certificate of
authority upon receiving satisfactory proof of the facts set forth
in the completed application and upon receipt of an application
fee of $ 25.00
Section 2. This ordinance shall become effective immediately upon
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, this 9th day of June , 1980.
