ORDINANCE NO. 502
AN ORDINANCE RELATING TO ELECTIONS.
REVISING SECTIONS 8-3 AND 8-7 OF THE SE1.ARD CITY CODE
THE CITY OF SEWARD, ALASKA, ORDAINS:
Section 1. Section 8-3 of the Seward City Code is hereby revised
to read as follows:
Sec. 8-3 Qualification of voters.
(a) In accordance with AS 15.05.010, a person is qualified to
vote who:
.
(1) is a citizen of the United States;
(2) is 18 years of age or older;
(3) has been a resident of the state and of the city
for at least 30 days just before the election; and
(4) has registered before the election as required
under AS 15.07 and is not registered to vote in
another jurisdiction.
(b) State voter registration is prima facie evidence of a
voter's qualification, but every election official shall
challenge, and every watcher and other person qualified to
vote in the precinct may challenge a person attempting to
vote if he believes the person is not qualified to vote.
If the voter's polling place is in question, the voter
shall be allowed to vote a questioned ballot. A person who
frivolously, maliciously or in bad faith challenges a voter
or questions his ballot is guilty of a misdemeanor.
Section 2. Section 8-7 (b) of the Seward City Code is hereby
revised to read as follows:
Sec. 8-7. Nomination of candidates by petition.
(b) Nominations for elective offices shall be by petition only.
To be eligible to file a nominating petition for election to a
city office, a person shall be an elector of the city or of the
territory annexed to the city, or shall have had a combination

of residence in the city and in the annexed territory for a
period of not less than one year immediately preceding the
date of filing such a petition. Such petition shall be
signed by at least ten electors; who shall be residents
and qualified voters within the city. No elector shall
sign more than one such petition, except as to councilmen,
in which case as many petitions may be signed as there are
vacancies for the position of councilman. Should an elector
sign more than the permissible number of petitions, his
signature shall be void as to any petition filed subsequent
to the filing of petitions in such number bearing his
signature. With each signature shall be stated the place
of residence of the signer, giving the street and number
or lot and city block or other description sufficient to
identify it. Nominating petitions forms shall be provided
by the city clerk and shall include provision for a statement
by the candidate affirming his qualifications to fill the
office to which he is nominated, and his willingness to do so.
Section 3. This ordinance shall become effective ten days following
enactment.
