Introduction Date: 09/27/82 Public Hearing & Enactment Date: 10/11/82 Cripps CITY OF SEWARD, ALASKA ORDINANCE NO. 512 AN ORDINANCE OF THE CITY OF SEWARD, ALASKA, CREATING AN INTERNATIONAL TRADE AND INDUSTRY DEVELOPMENT ADVISORY BOARD WHEREAS, the Port of Seward continues to develop as an inter- national service and trade port that is centrally located to the Alaska maritime fleet, and at the crossroads of the North Pacific Ocean; and WHEREAS, the City of Seward is constructing a multi-million dollar marine industrial complex and bulk cargo handling area in the Fourth of July Creek valley; and WHEREAS, the Port of Seward is the most logical and economical port through which Alaska coal, grain, and bulk materials will be ex- ported and imported; and WHEREAS, the Port of Seward is the only ice-free, deep water Alaska port that serves the major population centers of the state by rail, highway and air transportation systems; and WHEREAS, the City Council of the City of Seward favors economic development through wise management and promotion of its harbor and marine facilities; and WHEREAS, Section 3.6 of the Seward City Charter authorizes the City Council to appoint citizen boards for such advisory purposes as needed; NOW, THEREFORE, THE CITY OF SEWARD ORDAINS AS FOLLOWS: Section 1. The following Article 2.55 is added to Chapter 2 of the Seward City Code: Article 2.55. International Trade and Industry Development Advisory Board Sec. 2.55.010 Established. (a) The International Trade and Industry Development Advisory Board is hereby created, consisting of five residents of the City of Seward or surrounding areas, and who shall be nominated by the Mayor and confirmed by the City Council. No officer or employee of the City may be an appointed member of the Board. . . . CITY OF SEWARD, ALAS~ ORDINANCE NO. 512 Page 2 . (b) A chairman of the Board shall be selected annually by the appointed members. (c) The City Manager will appoint a City employee to serve as an ex officio member of the Commission who shall have the privilege of the floor but not the right to vote. Sec. 2.55.020 Terms of Office - Filling Vacancy in Office. (a) Members of the International Trade and Industry Development Advisory Board shall be appointed for a term of five (5) years provided that the terms of initial appointments shall be staggered so that as near- ly as possible a pro rata number of members shall be appointed for each year during the regular term of office established. (b) The Mayor, with the approval of the City Council, may appoint any qualified person to fill a vacancy of any member of the Board provided that the appointment shall be for the unexpired term of the vacancy. (c) Following a member's absence from three (3) consecutive regu- lar meetings of the Board, the remaining Board members shall decide whether the board member should be retained or whether to request Council appoint- ment of a new member. (d) Members shall not be paid for services on the Board or par- ticipation in Board activities without prior approval of the City Council. Sec. 2.55.030 Meetings and Quorum. (a) The Board will meet at a time and place to be designated by the Board. (b) Three (3) members of the Board shall constitute a quorum for the transaction of business except that, in the absence of a quorum, any number less than a quorum may adjourn the meeting to a later date. The affirmative votes of at least a majority of those board members present shall be required for any action. (c) All meetings and records of the Board shall be open to the public. The Board shall keep minutes of proceedings showing the vote of each member upon each question and shall keep records of any actions, all of which shall be immediately filed in the office of the City Clerk and shall be a public record. Sec. 2.55.040 Powers and duties. It shall be the responsibility of the International Trade and Industry Development Advisory Board to: (a) Report annually to the City Council at the first Council meeting of the new fiscal year. The report shall include, at the minimum, . . . CITY OF SEWARD, ALAS" ORDINANCE NO. 512 Page 3 . a report on the prior year's activities, a list of any anticipated re- quests for appropriations for the year's planned activities and a re- commendation regarding the continuation of the Board. (b) Review and make recommendations to the City Council regarding further expansion of the trade potential of the Sister City/Sister Port agreements as well as any other potential trade ports. (c) Make recommendations to the City Council concerning the de- sign and coordiantion of projects to promote and develop domestic and international transportation and trade links through the Port of Seward. (d) Provide input to the City Council on matters involving the establishment of industry related to the movement of fish resources and bulk commodities such as coal, grain, timber, minerals and other re- sources from Alaska through the Port of Seward. (e) Advise the City Council on matters involving the establish- ment of support services pertaining to the Port of Seward. (f) Provide advice and recommendations regarding the use and operation of the Seward Custom Bonded Warehouse. (g) Be the coordinating body for the Seward-Obihiro Student Exchange and Friendship Committee activities. (h) Perform other duties as requested by the City Council. (i) The Board shall have no authority to expend or commit City funds without first obtaining approval by and any necessary appropriations from the City Council. Sec. 2.55.050 Continuation of Board. The City Council, at the first meeting of each fiscal year by an affirmative vote, may continue the existence of the Board. In the absence of an affirmative vote by the Council, the Board will cease to exist within thirty (30) days. Section 2. after its enactment.
