ORDINANCE NO. 545
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SEWARD, ALASKA, AMENDING SECTION 15-18 OF THE CITY
CODE RELATIVE TO THE POSSESSION OF FIREWORKS
WHEREAS, the discharge of fireworks within the City of Seward
represents a danger to life and property of the citizens of Seward; and
WHEREAS, present Code provisions do not prohibit the posses-
sion of fireworks; and
WHEREAS, enforcement of the City's prohibition against dis-
charge of fireworks is an increasingly difficult problem for City law
enforcement officers; and
WHEREAS, a prohibition against possession of fireworks on
public streets, parks and other public places would greatly reduce the
incidence of illegal discharge of fireworks and thus reduce risk of fire
and injury from such illegal discharges in public places; and
WHEREAS, the prohibition against the possession of fireworks
in public places would not infringe upon the public's right to possess
fireworks on private property for later discharge in areas outside the
City where such discharge is not restricted;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, HEREBY ORDAINS that:
Section 1. Section 15-18 of the Seward City Code is hereby
repealed and re-enacted to read as follows:
Sec. 15-18. Possession and discharge of
fireworks. (a) No person shall barter, sell,
exchange or give away, or set off, fire or explode,
or cause to set off, fired or exploded, any fire-
cracker, sky rocket, pin wheel, fusee, Roman candle,
bomb or any pyrotechnical contrivance or apparatus
of any description within the city without prior
approval of the city council.
(b) No persons shall have any firecracker, sky
rocket, pin wheel, fusee, Roman candle, bomb or any
pyrotechnical contrivance or apparatus of any
description in his possession on the public streets,
parks or any other public place. This subsection
shall apply to the following areas within the City
of Seward:
Central Business Disptrict - defined as
that area including on the north-Jefferson

Street, on the west-Third Avenue, on the
East-Fifth Avenue and south to the the
waterfront.
Small Boat Harbor Area - defined as that
area including on the north-Old Airport
road, on the south-Van Buren Street, on
the west-Third Avenue and to the
waterfront to include the Small Boat
Harbor Basin.
Forest Acres Campground.
Section 2. This ordinance shall take effect 10 days following
enactment.
