ORDINANCE NO. 552
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SEWARD, PJASKA, ESTABLISHING A CXl1MUNITY HOSPITAL BOARD
HtlliREAS, the Seward General Hospital Association (the "Asso-
ciation"), an Alaskan Corporation, has operated the Seward General
Hospital ("Hospital") for many years; and
WHEREAS, the Association has provided an invaluable service to
the carmmity by focusing public concern for the cannunity's health care
needs, nnbilizing public support to meet those needs, and providing
voltmteer medical and professional advice and concern for the operation
of the Hospital; and
vJHEREAS, the Association has not been able to provide an
adequate retirement plan for its employees; and
WHEREAS, the Association is interested in Hospital employees
becoming City employees to be eligible for an improved retirement
system; and
WHEREAS, the City has recognized the public I s interest in
continued operation of the Hospital by the contribution of City revenues
to the operation of the Hospital and the lease of public facilities to
the Association at nominal rent; and
WHEREAS, the City of Seward wishes to encourage the Asso-
ciation's continued active participation in the health care issues of
the City; and
WHERF.AS, the City COlIDCil wishes the Cannunity Hospital Board
rraroers to be selected and nominated fran the membership of the Seward
General Hospital Association;
N(M, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD,
PJASKA, HEREBY ORDAINS that:
Section 1. Article Dl(A) of Chapter 2 of the Seward City Code
is enacted to read as follows:
ARTICLE IV (A) . CXl1MUNITY HOSPITAL BOARD
Sec. 2-55(a).1. Established. (a) There is
hereby created a Community Hospital Board consisting
of nine residents of the City of Seward or the East
Peninsula Road Service Area who shall be appointed
by the City Council. The tenns of three Board

shall fill the unexpired term of the Board member by
appointrrent. No employee or officer of the City of
Seward may serve as a member of the Conm.mi ty
Hospital Board.
(b) Appoint:rrent by Council. In order to
assure the continued support and involverrent of the
Seward General Hospital Association in supporting
the operation of City hospital facilities and
further to assist the City COlIDcil in the appoint-
ment of Board rrembers, the Seward General Hospital
Association shall select and reconmend persons to
the COlIDcil for appoint:rrent to serve vacant
positions on the Conm.mity Hospital Board.
Sec. 2-55(a) .2. Powers and duties. The
Hospital Board shall be responsible for fumishing
of rmmicipal hospital services necessary for the
protection of the health of the public. It is
empowered to:
a. Receive, consider and evaluate public
input, opinions and recorrmendations regarding the
participation of the City in hospital health pro-
grams within the City;
b. Implement Hospital programs and budgets
for the City;
c. Employ, promJte, discharge and direct
employees as provided in this Article;
d. Act as the local board for the purposes of
dealing with any operators or managers of hospital
facilities owned or operated by the City, exercising
and performing those Dmctions granted to and
required of the board by the provisions of any
agreement between the City and operators of those
facilities;
e. Develop policies and rules for the conduct
and frequency of its own meetings; and
f. Perform such other activities as may be
requested of it by the City.
Sec. 2-55(a) .3. ~loyees. The Conm.mity
Hospital Board shall appo~t, compensate and other-
wise control City personnel who work for the City of
Seward Hospital facilities and those employees shall
not be subj ect to the provisions of Chapter 17 of

the Seward Mtmicipal Code. The terms and conditions
of their errployment vrl.ll be governed by the policies
and procedures adopted by the Conmmity Hospital
Board.
Sec. 2-55(a) .4. Audit. The Hospital Board
shall, before October 31 of each year, provide the
City C01.mcil with a copy of an audit of all Hospital
accmmts for the year ending June 30. Said audit
shall be conducted by a certified public accountant.
Sec. 2-55(a) .5. Budget. The Hospital Board
shall, before Hay 1 of each year, submit to the City
Council a proposed budget for the following fiscal
year for approval of the total amount. Within 60
days after receipt of the budget the City Council
shall determine the total amount of rroney to be made
available fran local sources for Hospital purposes
and shall furnish the Hospital Board with a
statement of the sum to be made available. If the
Council does not, within 60 days, furnish the
Hospital Board with a statement of the sum to be
made available, the amount requested in the budget
is automatically approved. By July 1, the Council
shall appropriate the amount to be made available
fran local sources from rooney available for the
purpose.
Sec. 2-55(a) .6. Char~s for services. The
Conmmity Hospital Board s 11 have the exclusive
power and authority to set rates for the provision
of hospital health care services to the corrmunity
within the limits set forth in the armual budget.
Sec. 2-55(a).7. Facilities. The Council shall
determine the location of hospital facilities with
due consideration to the recarnnendations of the
Hospital Board. The Hospital Board is responsible
for the design criteria of hospital buildings. To
the maximum extent consistent with hospital needs, a
design of a hospital facility shall provide for
multiple use for corrmunity purposes. Subject to the
approval of the Council, the Hospital Board shall
select the appropriate professional personnel to
develop the designs. The Hospital Board shall
submit preliminary and subsequent designs for
hospital facilities to the Council for approval or
disapproval, and if the design is disapproved, a
revised design shall be prepared and presented to
the Council.

The Hospital Board shall provide custodial
services and routine rraintenance of hospital facil-
ities and the City shall provide for all rrajor
rehabilitation, construction and rrajor repair of
Hospital facilities.
Sec. 2-55 tal. 8. Relationship with Seward
Ceneral Hospital Association. THis ordinance does
not limit the authority of the Seward Ceneral
Hospital Association to continue existing programs
and policies inCluding, but not limited to:

a. Prarotion of public involverrent in and
concern for health care within the corrmunity;
b. Encouragerrent of charitable donations to
the corrmuni ty health facilities and programs;
c. Auxiliary and volunteer activities; and
d. The power to hold and manage assets.
Section 2. The City of Seward shall accept the responsibility
for the operation of the Seward General Hospital as of January 1, 1986.
Section 3. The initial rrembership and terms of the Conmunity
Hospital Board shall consist of the current Board rrembers of the Seward
General Hospital Association.
Section 4. This ordinance shall becare effective only upon
v approval of the Seward General Hospital Association of the transfer of
the operation of the Seward General Hospital to the City of Seward.
Section 5. Employees of the Seward General Hospital Asso-
ciation shall be offered employrrent by the Cormnmity Hospital Board on
behalf of the City of Seward.
