CITY OF SEWARD, ALASKA
ORDINANCE NO. 619
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, REGULATING HOURS OF OPERATIONS
OF ESTABLISHMENTS THAT SELL ALCOHOLIC BEVERAGES
WHEREAS, the city has the authority under state law to
enact reasonable regulations as to the operation of establishments
that sell alcoholic beverages within the city; and
WHEREAS, city Code provisions with respect to regulating
sale of alcoholic beverages have not been reviewed by the City
Council in a comprehensive manner since 1960; and
WHEREAS, the public interest would be served by the city
of Seward taking a more active role in the regulation of
establishments that sell alcoholic beverages; and

increases the frequency and severity
intoxicated persons within the city; and

WHEREAS, the city Council of the city of Seward finds
there is a correlation between the operation of establishments that
sell liquor and public health problems associated with alcohol
abuse; and
WHEREAS, alcohol related incidents comprise a substantial
burden upon the city's health and safety resources; and
WHEREAS, in order to meet the increased burden on public
resources, the city has had to increase its support of health and
safety organizations; and
WHEREAS, the City Council determines that it would be in
the public interest to amend the hours of operation of
establishments that sell alcoholic beverages within the city
limits; and
WHEREAS, reducing the hours of operation of
establishments within the city that sell alcoholic beverages would
have a beneficial impact on the public health and safety of the
community; and
WHEREAS, the city has considered a number and variety of
measures to deal with the pervasive alcohol abuse problem
within the city and finds that the regulation of hours during which
an establishment may sell alcoholic beverages is reasonably
calculated to deal with a severe public health and safety problem;

ORDINANCE NO. 619
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, HEREBY ORDAINS that:
Section 1. Section 8.05.045 of the Seward City Code is
hereby amended to read as follows:
8.05.045 Hours when sale. etc.. orohibi ted. No licensee
or employee of a liquor establishment shall sell, furnish, give,
or deliver any intoxicating liquor between the hours of 2:00 a.m.
and 10:00 a.m. of any day.
Section 2. This ordinance shall take effect at 12:01
a.m., October 1, 1989.
ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, this 28th day of August, 1989.
