Sponsored by: Schaefermever CITY OF SEWARD, ALASKA ORDINANCE NO. 644 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, APPROVING AN ALCOHOL AND DRUG POLICY FOR CITY EMPLOYEES WHEREAS, the City Council wishes to insure workplace safety for the city employees, fellow co-workers and third parties from incidents and accidents which could occur due to misuse of drugs and alcohol that could affect performance and safety; and WHEREAS, the City Council wishes to invite city employees suffering problems with drug and alcohol abuse to seek treatment in order to return to work in a fit manner; and WHEREAS, drug and alcohol policies are required by the federal government through the Drug Free Workplace Act in order for the city to receive federal monies in excess of $25,000; and WHEREAS, it is in the best interests of the city to establish standards for employees and to give employees notice of the city's expectations relating to the use of drugs and alcohol; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY ORDAINS that: section 1. A new Chapter 3.70 of the Seward City Code, Standards Relating to Drugs and Alcohol, is hereby created to read as set forth in Attachment A, incorporated herein by reference. section 2. This ordinance shall take effect ten (10) days following its enactment. ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this 11th day of February, 1991. Chapter 3.70 Standards Relatina to Druas and Alcohol Sections: 3.70.010 3.70.015 3.70.020 3.70.025 3.70.025 3.70.030 3.70.040 Standard Policies Prescribed Medications Reporting Convictions Consuming Prohibited During Shift Breaks Reporting Fit For Work Negligent Hiring and Pre-employment Screening Off Duty Use Affecting Performance or Conduct 3.70.010 Standard Policies A. Employees will be terminated for use or possession of alcohol or illegal drugs or at the work site during work hours. Unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited in the work place. . B. Employees are encouraged to voluntarily seek professional support for drug or alcohol-related problems. Employees who seek treatment shall discuss the situation with their supervisors if leave time, with or without pay, is required for the employee to obtain treatment or hospitalization. 1. Supervisors are encouraged to grant leave, with or without pay, for such requests. 2. When leave without pay is involved, the employee shall provide a statement from the attending physician or counselor to the supervisor, stating that treatment is being received and describing the length of the treatment program. 3. An employee's job security or promotion opportunities shall not be jeopardized by a request for leave to obtain counseling or treatment. C. In all matters concerning employees' drug or alcohol-related problems, strict confidentiality shall be maintained by supervisors, administrators and administrative support personnel. . 3.70.015 Prescribed Medications . . . CITY OF SEWARD, ALASKA Ordinance No. 644 ATTACHMENT A A. Employees using prescribed medications that have side effects that may affect their performance, their safety, or the safety of others are required to notify their supervisors of such use and possible side effects. Supervisors may consider reassignment of duties for those employees for those days. Failure to report the use of such a prescribed medication with potential side effects that could affect an employee's work performance, safety, or the safety of others may result in disciplinary action. 3.70.020 Reportina Convictions A. Employees must, no later than five (5) days after conviction, notify their employer of such conviction(s) for criminal drug statute violations occurring in the work place. 3.70.025 Consuming Prohibited During Shift Breaks A. Employees on breaks ~, lunch, dinner, rest breaks, etc.) are not allowed to return to their work sites for the completion of their shift if alcohol or controlled substances are consumed during the break. Employees shall not receive pay for the hours during which they are not permitted to return to work for such reasons. 3.70.030 Reportina Fit For Work A. Employees are required to report to their work site in a condition that will allow them to perform their required duties in a proper, safe manner. An employee who is temporarily incapable of performing assigned or required job duties will be released from the work site and, if necessary, returned to his or her residence by a fellow employee. Employees shall not receive pay for the hours of release. 3.70.035 Negligent Hirina and Pre-employment Screening A. The City will not hire an individual whose previous employment has been adversely affected by use of illegal controlled substances or alcohol abuse. For city positions requiring public security, administrative confidentiality, working with youth and cash handling, new hires will be required to undergo a criminal background check. 3.70.040 Off Duty Use Affecting Performance A. Excessive use of alcohol off duty, or off duty use or involvement with illegal drugs that affects an employee's job performance or conduct may result in disciplinary action. . . .
