CITY OF SEWARD, ALASKA
ORDINANCE NO. 645 (SUBSTITUTE)
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AMENDING SECTION 9.15.350
OF THE CITY CODE, REGULATING ABOVE GROUND
FUEL STORAGE TANKS
WHEREAS, the City Code currently limits the placement of above
ground fuel storage tanks to the industrial zones north of the
Small Boat Harbor and south of the Lowell Creek diversion outfall;
and
WHEREAS, the City Code currently disallows the placement of
large above ground fuel dispensing tanks within the city; and
WHEREAS, the city desires to allow the placement of such tanks
in the appropriate zones of the city where underground storage
might be impractical or environmentally risky, provided that
certain established criteria are met;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA
HEREBY ORDAINS that:
Section 1. Section 9.15.350 of the City Code is hereby
amended to read as follows:
9.15.350 Petroleum and qas storaqe tanks. A.
Except as provided in Sections B. and C. below, the
construction, enlargement, or relocation of above-ground
storage tanks for bulk petroleum or gas is prohibited in
the city.
B. Above ground storage tanks for bulk petroleum or
gas shall be allowed in the Industrial Zone provided that
a permit is obtained from the Fire Chief.
C. Above ground vehicle fuel dispensing tanks
measuring 2,000 - 5,000 gallons in size shall be allowed
in the Industrial Zone, the Auto-Commercial Zone and the
Institutional Zone provided that a permit is obtained
from the Fire Chief. All above ground vehicle fuel
dispensing tanks shall be installed in accordance with
the Uniform Fire Code and the criteria established by the
State Fire Marshal's Office.
Section 2. This ordinance shall take effect ten (10) days
following its enactment.
ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA,
this 11th day of February, 1991.
