ORDINANCE NO. 93-23
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, AMENDING SEWARD CITY CODE
CHAPTER 2.30 TO PROVIDE FOR THE ESTABLISHMENT
OF THE PORT AND COMMERCE ADVISORY BOARD
WHEREAS, in 1982, the City Council established the Trade and Commerce
Advisory Board to advise the Council on a number of development issues including the
expansion of port related trade and commerce and the promotion of international trade
links for the port of Sewardj and
WHEREAS, in 1989, the City Council appointed the Port Development Advisory
Committee to review port and harbor operations and to make recommendations to the
Council regarding port and harbor expansion and other port related issuesj and
WHEREAS, in recognition of the over-lapping roles of the two boards, the
members of the boards have requested that the Council consolidate them into one nine-
member board to be designated the Port and Commerce Advisory Boardj
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA HEREBY ORDAINS that:
Section 1. Seward City Code Chapter 2.30, Article 300, Sections 2.30.310, et. seq.,
is hereby repealed and re-enacted to read as follows:
Article 3. Port and Commerce Advisory Board
2.30.310 Established.
A. The port and commerce advisory board is hereby created, consisting of
nine residents of the City of Seward or surrounding areas, and who shall be
nominated by the mayor and confirmed by the city council. No officer or employee
of the city may be appointed a member of the board.
B. A chairman of the board shall be selected annually by the appointed
members.
C. The city manager will appoint a city employee to serve as an ex officio
member of the board who shall have the privilege of the floor but not the right to
vote.

A. Members of the port and commerce advisory board shall be appointed
for a tenn of three years; provided, that the tenns of initial appointments shall be
staggered so that as nearly as possible a pro rata number of members shall be
appointed for each year.
B. The mayor, with the approval of the city council, may appoint any
qualified person to fill a vacancy of any member of the board provided that the
appointment shall be for the unexpired tenn of the vacancy.
C. Following a member's absence from three consecutive regular meetings
of the board, the remaining board members shall decide whether the board member
should be retained or whether to request council appointment of a new member.
D. Members shall not be paid for services on the board or participation in
board activities without prior approval of the city council.
2.30.320 Meetings and quorum.
A. The board will meet at a time and place to be designated by the board.
B. Five members of the board shall constitute a quorum for the transaction
of business except that, in the absence of a quorum, any number less than a quorum
may adjourn the meeting to a later date. The affinnative votes of at least a
majority of those board members present shall be required for any action.
C. All meetings and records of the board shall be open to the public. The
board shall keep minutes of proceedings showing the vote of each member upon each
question and shall keep records of any actions, all of which shall be immediately
filed in the office of the city clerk and shall be a public record.
2.30.325 Powers and duties.
A. It shall be the responsibility of the port and commerce advisory board
to:
1. report annually to the city council at the first council meeting
of the new fiscal year and at any other time as may be requested by the city council.
The annual report shall include, at the minimum, a report on the prior year's
activities, a list of any anticipated requests for appropriations for the year's planned
activities and a recommendation regarding the continuation of the board;
2. make recommendations to the city council concerning the design
and coordination of projects to promote and develop domestic and international
transportation and trade links through the port of Seward;
3. provide input to the city council on matters involving the
establishment of industry related to the movement of fish resources and bulk
commodities such as coal, grain, timber, minerals and other resources from Alaska
through the port of Seward;
4. advise the city council on matters involving the establishment of
support services pertaining to the port of Seward;
5. perfonn other duties as requested by the city council.

B. The board shall have no authority to expend or commit city funds
without first obtaining approval by and any necessary appropriations from the city
council.
2.30.330 Continuation.
The city council, at the first meeting of each fiscal year by an affirmative
vote, may continue the existence of the board. In the absence of an affirmative vote
by the council, the board will cease to exist within thirty days.
Section 2. This ordinance shall take effect ten (10) days following its enacbnent.
ENACTED BY THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA, this
28th day of June, 1993.
