ORDINANCE NO. 94-17
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF SEWARD, ALASKA, ESTABLISHING A PARKING ASSESSMENT
FEE FOR HARBOR AREA BUSINESSES
THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA HEREBY
ORDAINS that:
Section 1. Seward City Code Section 15.10.215, Parking, Subsection A, is hereby
amended to read as follows:
15.10.215 Parking.
A. Except in the CB district, there shall be provided permanently
maintained off-street parking for each principal business and each marine charter
business. It shall be the responsibility of the business owner or marine charter
business operator to provide and maintain said off-street parking in accordance with
this chapter continuously during the life of the business or the operation of the
marine charter business.
Section 2. New Sections 15.10.245 - 15.10.260 of the Seward City Code are hereby
created to read as follows:
15.10.245 Parking assessment fee.
In the event an owner of a principal business in the harbor commercial
district or marine charter business owner is unable to provide the number of spaces
required by this chapter, the owner shall pay an annual fee initially set at $125.00
and hereafter to be detennined annually by ordinance for each parking space that
is required but not provided.
15.10.250 Payment and collection of parking assessment fee.
A. The finance department will bill the owner of each existing business
in the harbor commercial district and each marine charter business owner for all
fees owed under this chapter not later than 90 days from the effective day of this
chapter and no later than January 31 of each subsequent year. A new business
established after January 1 of any year, or a business undergoing alteration,
enlargement or change in use after January 1 or any year which increases the
number of parking spaces required under this chapter, must pay all assessments

required under this chapter for that calendar year before a business license will be
issued.
B. The finance department may authorize payment on an annual,
semiannual or quarterly basis, with additional fees to be detennined by the finance
department to cover administrative costs associated with partial payments.
15.10.255 Penalties for failure to pay parking assessment fee.
A. All past due parking assessment fees may be recovered in an action
at law against the business owner along with all reasonable attorney's fees and
costs incurred by the city in recovering the past due parking assessment fees.
B. A business owner who willfully fails to pay the parking assessment
fee required by this chapter shall also be subject to a civil penalty equal to twice the
amount of all past due parking assessment fees that should have been paid.
C. All fees and penalties collected by the city under this chapter shall
be deposited in the city's general fund.
15.10.260 Regulations.
A. The city manager may adopt regulations applying and interpreting
this chapter and may prescribe fonns required for the administration of this chapter.
B. Any person may apply to the city manager for a ruling on the
application of this chapter to that person's business. If the city manager detennines
that such a ruling has general application, he may adopt it as a regulation.
Section 3. This ordinance shall take effect thirty (30) days following its enactment.
