CITY OF SEWARD, ALASKA
ORDINANCE NO. 397
A SPECIAL ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF SEWARD, ALASKA, DECLARING AN
EMERGENCY AND AUTHORIZING THE IMMEDIATE
EXECUTION OF A LEASE AGREEMENT FOR LOTS 13
AND 14, SEWARD INDUSTRIAL PARK.
WHEREAS, it is in the public interest of the City of
Seward to consummate that lease for Lots 13 and 14, Seward Indus-
trial Park, between the City and Seward Fisheries, and
WHEREAS, an emergency situation exists in that Seward
Fisheries requires immediate execution of this lease in order to
complete its financing commitments and begin construction of the
improvements on these parcels.
THEREFORE, THE CITY OF SEWARD ORDAINS:
Section 1. That an emergency in fact exists in accord
with Section 4.1(b) of the City Charter and Section 2-80(b)(3) of
the Code of Ordinances of the City of Seward. The enactment of
this ordinance is required to alleviate this emergency, and insure
proper and timely construction of these improvements, which will
constitute a substantial addition to a substantial industry located
within the City of Seward.
Section 2. The City Manager is authorized and directed
to immediately execute the lease of Lots 13 and 14, Seward Industrial
Park, to Seward Fisheries, in accord with the lease form dated October
1, 1973, approved by the attorneys for the re$pective parties, and
in generally the same form as the standard lease of the City of
Seward properties.
Section 3. This ordinance takes effect immediately upon
passage and approval.
PASSED AND APPROVED by the City Council of the City of
Seward, Alaska, this 14th day of January, 1974.

Enclosed is an emergency ordinance relating to Lots
13 and 14, Seward Industrial Park. It can be enacted in accord
with Section CSO(b)(3) at the January 14 meeting, and the lease
executed immediately thereafter and forwarded to Mr. Rolfe.
I believe that this will conclude the matters dealing
with the Seward Fisheries leases. If you have any questions,
please let me know.

I am writing this letter as a follow-up to our recent telephone
conversation and a letter to you from James R. Filip dated December
26, 1973.
I understand that the delay until February 14 will cause some
problems with your finanCing. Accordingly, I have drafted an emer-
gency ordinance which will allow immediate signing of the lease follow-
ing Council approval. Accordingly, you should be receiving it within
a few days after January 14, 1974.
