ORDINANCE NO. 409
AN ORDINANCE DETERMINING THE LOCATION FOR FUTURE CONSTRUCTION
OF BULK PETROLEUM OR GAS STORAGE TANKS WITHIN THE
CITY OF SEWARD
WHEREAS, above ground bulk storage tanks for petroleum
products presently exist in the industrial zoned area located
north of the Seward Small Boat Harbor, and
WHEREAS, it is in the public interest to restrict the
location of these bulk storage tanks to that one area, and
WHEREAS, an emergency exists in that plans presently
exist to proceed with the construction of bulk storage tanks
in other areas, and this ordinance is necessary to alleviate
the possibility that such construction may go forward immediately,
contrary to the public interest.
NOW, THEREFORE, THE CITY OF SEWARD, ALASKA, ORDAINS:
Section 1. Section 11-41 of The Seward Code of Ordinances
is hereby created to read as follows:
Sec. 11-41 Petroleum and Gas Storage Tanks.
The construction of above-ground storage tanks for bulk
petroleum or gas is prohibited in the City of Seward, except in
the industrial zoned area located north of the Seward Small
Boat Harbor and there only with special permission of the City
Council.
Section 2. This ordinance takes effect immediately upon
passage and approval.
