ORDINANCE NO. 428
AN ORDINANCE REPEALING AND RE-ENACTING SECTION 12-14 OF
THE SEWARD CITY CODE RELATING TO COLLECTION OF REFUSE AND GARBAGE.
WHEREAS, Section 12-14 of the Seward City Code should
be rewritten to clearly reflect the original legislative intent.
NOW, THEREFORE, THE CITY OF SEWARD, ALASKA, ORDAINS:
SECTION 1. Section 12-14 of the Seward City Code of
Ordinances-rs-hereby repealed and re-enactly to read as follows:
Sec. 12-14. Collection and Disposal.
The city shall provide for the collection and disposal of
rubbish, waste material and garbage from all residence, dwelling,
commercial and industrial units in the city. Such provision may be
made either by letting a contract for such collection and
removal, or otherwise. The public works department of the city or
the contractor shall have charge and supervision of such collection
and removal, and shall prescribe established routes and days for
collection and removal of rubbish, waste material and garbage from
residence, dwelling, commercial and industrial units so as to conform
with the provisions of any section of this article, and may change
the same from time to time. When such routes or days of collection
are established or changed, he shall give notice thereof in such a
manner as he deems best.
Rubbish, waste material and garbage shall be placed in
such containers or receptacles and on such container racks as
specified in this chapter.
The rubbish or waste material or garbage containers or
receptacles shall be placed for pickup on the property abutting a
dedicated public right of way adjacent to the residence, dwelling,
commercial or industrial unit within three feet of the right of
way, at a point determined by the public works department of the
city or the contractor. In no case shall rubbish, waste material
or garbage containers or receptacles be placed further in upon
private property for collection and removal, unless the public works
department of the city or the contractor shall have approved the
location. In no case shall the rubbish or waste material or
garbage containers or receptacles be placed upon the public right
of way.

SECTION 2. This ordinance takes place immediately upon
passage and approval.
Passed and approved by the City Council of the City of
Seward, Alaska this 13th day of December , 1976.
