CITY OF SEWARD, ALASKA
ORDINANCE NO. 99-11
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING TITLE 9 HEALTH AND SAFETY, CHAPTER 9.05
ANIMALS AND FOWL, REGARDING TRAPPING
WHEREAS, there are large tracts of undeveloped public lands and numerous parks within
the city limits that are used by the public for hiking, exercise and running their dogs; and,
WHEREAS, the public expects that themselves, their children and their pets should be able
to walk and play within the city without fear of being caught in traps; and,
WHEREAS, a number of pet dogs have been inadvertently trapped by snares within the city.
Some died, others survived because the owners found them in time:
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA
HEREBY ORDAINS that:
Section 1. Seward City Code Title 9 Health and Safety Chapter 9.05 Animals and Fowl
Section 9.05.110 Definitions is hereby amended as follows.

TraD shall be defined as the use of anv mechanical device such as a snare, steel i aw trap.
steel leg hold trap. Conibear or spring trap. that is designed to shut suddenlv upon contact to kill
or capture an animal.
Section 2. Seward City Code Title 9 Health and Safety Chapter 9.05 Animals and Fowl
shall be amended by adding a new Article 3. Hunting and Trapping
9.05.310 Trapping of animals prohibited. It shall be a violation ofthis chapter for any person to
trap, attempt to trap or aid and abet any person in trapping any animal, wild or domestic, within the
City of Seward, provided, that this section shall not apply to the following persons or activities:
A. Hunting, trapping, or capturing of animals or birds by city, state or federal law
enforcement, game department or animal control personnel while engaged in the performance of
their official duties or any other person authorized by the city manager or his designee for purposes
of animal control or research;

B. Hunting, trapping or capturing ofrats, mice, shrews, or similar vermin; or
C. The nonlethal live capturing of loose domesticated animals or birds by means designed
to ensure the safety and well-being of the animals. Any animal captured shall be cared for in a
humane manner and returned without unreasonable delay to the animal's owner or an animal control
officer.
9.05.315 Hunting prohibited in parks. No hunting, trapping or harassment of wildlife by any
means or methods whatsoever will be permitted within any municipally designated park area.
Section 3. This ordinance shall take effect ten (10) days following its enactment.
