ORDINANCE NO. 231
AN ORDINANCE TO PROVIDE FOR THE LICENSING AND OFl:T\l~TION OF CARD
GAMES R)R RECREATION AND AMUSEMENT ONLY.
BE IT CRDAINBD by the Common Council of the City of Seward:
Section 1. No person shall operate, or permit to be openatttd, any card game
in a ~ic establishment unless such operation is licensed. No such license
shall b. i.sued unless: (a) the card tables are readily accessible and visible
to the general publiCi (b) the card games to be operated are for recreation
and amusement onlYi (cd the police chief has oertified his approval of the
proposed. operations; (d) the application is accanpanied by an annual f.e plus
the fint quarterly pllyment. The annual liClense fee shall be I12S.00
pl.. 125.00- per quarter for each card table in operation during
such quarter or any portion thereof, such quarterly fees to be payable in
advuoe. Each table shall bear a sticker showing date of issuance and date
of expiration of license. No card g~ shall operate between the hours of
one o'olook A.He and six o'Clock A.Me
Section 2. Any license issued. by the City hereunder may be suspended or
revoked by the City Manager or issuing authority for cause. The licensee
shall haTe the right to a hearing before the Council ott any such action of
the City Manager of issuing authority, provided a written request therefor
i. filed with the City Clerk .'thin five days after receipt of notioe of such
suspension or revocation. The Council may confirm such suspension or revocation
or may revoke or zeinstate any .iulh license. The action taken by the Council
shall be final. Upon suapension or revocation of any license or permit, the
fee therefor shall not be refunded.
Section 3. The ten -cause- as used in this sect ion, shall include the doing
or sitting of any aot or permitting any condition to exist in connection
with any priTileqe for whioh a license or permit is granted under the provisions
of this Ordinance, or any premises or facilities used in connection therewith,
whioh act, omission or condition is:
(.) 80ntrary to the health, morals, safety or welfare of the publiol
(b) Unlawful, irregular or fraudulent in naturei
(c) Unauthorized or beyond the scope of the license or J:tIl'mi' granted; or
(d) Forbidden by the provisions of this Ordinance.
Section 4. The rules governing the introduction, posting, pa.ssage and approval
of ordinanoe. are hereby suspended and an emergency is declared, and this
Ordina.ce shall be effective immediately upon ita int~duation and passage
this 21st day of December, 1953.
