AN ORDINANCE TO PROVIDE FOR THE PUBLIC SAFETY AND CONVENIENCE: REQUIRING THE
REMOVAL OF SNOW AND ICE FROM SIDEWALKS BY AND AT THE COS! OF PROPERTY CMNERS:
AND UPON FAILURE OF THE PROPeRTY OWNER A~rHORIZING SUCH REMOVAL TO BE EFFECTED

SECTION 1.
Clearing Sidewalks of Snow and Ice.
(a)
No person having the care, either as owner, an agent of an owner, or
! occupant of any premises, bordered by a graded or paved sidewalk or sidewalks
I
!i shall fail to remove promptly any snow which may fall or ice which may form
II thereon.

! (b) Any person required under this Ordinance to remove snow and/or ice
I from any sidewalk or sidewalks shall effect such removal at his or her own cost
II within twenty-four (24) hours of the cessation of visible precipitation and in
event of failure to effect such removal within such period shall be deemed in
violation of this Ordinance and the pertinent sidewalk or sidewalks shall be
deemed in non-conforming condition with respect to the requirements of this

Ii Any person in violation of this Ordinance who by his or her failure to

SECTION 2.
Violation of Ordinance and Non-Conforming Condition of
Sidewalks; Gross Neglect of Public Safety.
or sidewalks in non-conforming condition shall be deemed guilty of gross neg-
lect of the public safety.

SECTION 3. Non-Conforming Condition of Sidewalks; Corrective Action by
City of Seward.
Whenever the sidewalk or sidewalks bordering any premises have been allowed,
through neglect of the public safety, to fall into a non-conforming condition
as set forth in Sub-section (b) of Section One of this Ordinance the City of
Seward acting by and through its City Manager shall on its own initiative
effect the removal of snow and/or ice from such sidewalk or sidewalks to the
extent necessary to eliminate the non-conforming condition and provide adequate
ly for the public safety and assess the cost of such removal against the pre-
mises bordered by such sidewalk. Any such assessment shall be a paramount lien
upon the premises against which it is assessed.
