ORDINANCE NO. 289
A N ORDINANCE fSTABLISHING RATES TO BE CHARGED FOR THE
SALE OF ELECTRICAL ENERGY AND PRESCRIBING 'l'HE CONDITIONS
UNDER WHICH SERVICES, FACILITIES AND ELECTRICAL ENERGY
SHALL BE MADE AVAILABLE TO THE GENERAL PUBLIC BY THE
SF.WARD ELECTRIC SYSTEM AND REPElILING ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT THERE\lITH,
WHEREAS, pursuant to applicable Territorial Law, the Seward Electric System
: did petition the City Council of the City of Seward for a revision of its rates

charges for the furnishing of electrical energy to the general public and,
WHEREAS, pur~uant to applicable Territorial Law, the City Council of the

prescribed by applicablel

City of Seward did hold a public hearing on the 29th day of December, 1958,
after having given due notice of such public hearing as
[Territorial Law and,
WHEREAS, the City Council of the City of Seward found as a result of such
hearings that the rates, fees and charges requested by the Seward Electric Syste
were necessary and reasonable;
NCM THEREFORE, BE IT ORDAINED by the Common Council of the City of Seward,
Alaska as follows:
Section 1:
That the rates, fees and charges hereinafter set forth are
reasonable rates, fees and charges to be made and collected for the services,
facilities and commodities of the Seward Electric System of said City of Seward,
and such rates, fees and charges are such as will produce revenue at least suff-
icient, (a) to pay when due all bonds and interest thereon, for the payment of
which such revenue is or shall have been pledged, charged or otherwise encumw
!bered, including reserves therefor; and (b) to provide for all expenses of
loperation and maintenance of said system, including reserves therefor.

Ithe consumer on whose behalf such service is being extended, shall deposit with
I the Seward Electric System as a credi t guarantee a sum of money equal to not
Iless than two months billings at the rate applicable to the class of service
Section 2:
Prior to the extension of electrical service to any premises,
being extended. Upon discontinuance of service and surrender of the deposit

receipt, said deposit shall be refunded less the amounts of any unpaid billings
for services rendered, which amounts shall be retained by the Seward Electric
ystem and the balance, if any remaining, shall be refunded to the consumer,
rovided however that in lieu of such cash deposit, at the option of the Seward
Electric System, a payment performance bond may be substituted.
Secti on 3:
Prior to the extension of service to any consumer there shall
be paid over to the Seward Electric System a connection charge in the amount of
$2.00, except however where such connection is made in the nature of a re-connec
tion where service was discontinued for reason of delinquent payment of monthly
bills, as hereinafter provided, there shall be paid over to the Seward Electric
System the sum of $5.00 for such reconnect ion.
Secti on 4:
All billings for the services of Seward Electric System shall
be rendered monthly and shall be due and payable on or before the 15th day of
the month following the month in which such services were rendered. Failure to
pay current billings by the 15th day of the month following, as aforesaid, shall
cause the consumer's account to become delinquent and thereupon a delinquent
penalty in the amount of 10% of the total billing shall be imposed and collected
and should the billing thereafter remain unpaid service shall be disconnected
and discontinued on the first day of the month following and no reconnect ion of
such service shall be made prior to the prepayment to the Seward Electric System
of the reconnection fee hereinabove provided for in such cases.
Section 5:
The service rates and charges to be made and collected for
services of the Seward Electric System and the classifications thereof are as
follows:
Schedule -A- Domestic
$6.00 for first 30 KWH or less per month
9~ per KWH for next 70 KWH
5~ per KWH for next 200 KWH
4~ per KWH for next 200 KWH
2~ per KWH for allover 500 KWH
Where any service in this schedule is being provided to a commercially
operated apartment house, which is hereby defined as an operation of not less
than four apartments contained within the same structure, and the tenant dis_
continues service, but the owner of the premises desires a continuance of

I service in order that any such apartment may be demonstrated to prospective tenM
ants, the service shall be extended to such owner at the rate of $2.00 per month
where no energy is actually consumed, provided however that where any energy is
consumed, it shall be charged for on the basis and at the rates shown in the
schedule.
Definition:. One family dwelling used as a residence only. Single phase
service for lighting, cooking and single phase motors incidental to domestic
appliances. Demand load not to exceed five horsepower.
Schedule "AA" Domestic All Electric
$12.00 for first 100 ~~I or less per month

2~ per KWH for all over 600 KWH
Where any service in this schedule is being provided to a commercially op-
erated apartment house, which is hereby defined as an operation of not less tha
four apartments contained within the same structure, and the tenant discontinue

shall be extended to such owner at the rate of $2.00 per month where no energy

Defini tion:
For residences using electricity for all cooking and hot
water heater and having 3 wire service and approved 30 gallon or larger auto-
matic water heater.
Schedule "E" Commercial
$12.00 for first 40 :KWH or less per month
10tt per KWH for next 60 :KWH
8~ per KWH for next 300 KWH
6tt per KWH for next 500 :KWH
5~ per KWH for allover 900 ~WH

cantile, industrial and other establishments not classed in Schedule "AN or .

Schedule "e" Power and Government
A minimum demand charge of $10.00 per month
5~ per ~NH for the first 10,000 ~~H
4~ for the next 10,000 KWH
3~ per KWH for all in excess of 20,000 KWH
Definition: Eligibility for this class of service requires a minimum
connected load of 50 Horsepower.

Service Outside Ci:t:L.~imits
To all billinqs for service outside the corporate limits of the city there
shall be added as a surcharge an amount equal to 10~ of the total amount billed.
The total amount billed shall be computed at the rates set forth in the
above schedules except that the following initial rates shall be substituted
for those shown in the applicable schedule:

All ordinances or parts of ordinances in conflict with the sections, sub.
sections or provisions of this ordinance are, to the extent of such conflict,
hereby expressly repealed.
The invalidation, for any reason, of any section, subsection or provision
contained in this ordinance shall be construed as being limited to the specific
section, subsection or provision and shall not operate to affect the validity
of the ordinance as a whole or any of its other sections, subsections or pro-
visions.
.~ emergency is hereby declared to exist and the rules governing the read-
ing and passage of ordinances and resolutions are hereby suspended and this
ordinance is given effect upon the passing of ten days after the date of its
passage and approval.
