Section 2. ~!:.Q~-\:1i Council PcMers: This code shall be deemed an exercise
of the powers 01' the Council of the City of Seward for the protection, safe-
guarding, and orderly mcorage and control of bC'ats, and for the protection and
general welfare ~f th'3 public, and all of its provisions shall be liberal]y
construed for the accomplishment of that purpose.
Section 3. Effect of Invalidity: If any provision of this code or the applica-
tion thereof to any person or circumstance is held invalid, the remainder of the
code and the applic ation of such provision to other p~rsons or circUIllBtances
shall not be affected thereby.
Section 4. 1J:xistinJJ: Ordinances Repealsd: Existing ordinances, or parts thereof
in conflict herewith are hereby repealed.
Section 5. Duty of Boat OWner~ Every act or statement required to be made by
a vessel owner or agent of such owner shall be made by the owner in person, or
it bY' an agent the necessity thereof shall be stated and shown; provided, that
the operator of any vessel shall, for the purposes of this act, be considered
the lsgal agent ~t the owner. It shall be the duty of the operators of all
boats tieing up to facilities in the Small Boat Harbor to register with the
Harbor l-iaeter, giving the name and ownership, registration, overall length, bearn,
and draft of said boats
Section 6. Moorins: Char~s: A schedule of mooring and otmr charges shall be
established bY' the I.tanager, with the approval ot the COnDlon Council, and shall
be subject to review as occasion demands. All fees and other approved charges
when due and unpaid shall become a lien against the boat.
Sect:1.on 7. Use of Revenue: All revenue from the Seward Boat Harbor shall be
expended for maintenance, operation and improvement of the Seward Boat Harbor.

Section 8. Beach storage: Due to limited beach space, beach storage shall
be limited to:
(a) April 1 to October 31 - That necessary for emergency repairs only.
(b) Hovember 1 to April 1 - Hint er storage for that space which is available
on a first come basis with approved permit and agreement.
Section 9. Harbor Easter: A Harbor 11aster, who shall have police powers, shall
be appointed in the same manner as other City emplo~rees. Said Harbor r'Iaster
shall be assigned to enforce the provisions of this code, shall establish an
adequate fire and security watch, maintain an accurate log of the registration
data or all boats using Small Boat Harbor .facilities showing the dates of
occupancy of berthing facilities, and collect or arrange .for the collection of
the fees established by the Harlager with the approval o.f the Council.
Section 10. Safety & SanitarY Rerollationll: Shall be established ty the"Marlager
with'.the. .approva1.of:-the Council and posted at the Small Boat Harbor.
Section ll. Rules and Regulations:
(a) Upon advance payment o.f slip rental, each boat owner will be assigned a
number B.'1d a berth. This number and berth will remain in effect .for the
duration o.f paid slip rental. No :party may use any berth not asSigned to
them, without first securing written pennission o.f the right.ful occupant.
Hhen all noat frontage has been assigned, additional floats ma;y be assigr
ed .for multiple berthing.
(b) Berths and numbers will be assigned
and/or the lUutager.
(c) IINO PARI:nmil areas will be established at such times and places as may be

determined by the IIanager.
(d) Violation of IINO PARKDIGIi areas ma;y be fined according to City Traffic
Code.
(e) ~lNO PARKINGl' areas pertain to the parking of any vehicle, private or
conunercial.
(f) A portion of the available float shall be posted and set aside .for the use
of transient .fishing vessels and other visiting craft in such places and
to such extent as the exi[;encies of the situation may permit. Moorage in
this area shall be under the jurisdiction of the Harbor Haster or the
lfanager.
(g) Permission of the Harbor Baster and/or IIanager shall be secured;rior to

An emergency is hereby dec181:ed to exist and the rules govurtting the passage of
Ordinances are bereby suspended and the third reading of this Ordinance by Title
anci Number was heard on March 6. 1961. Thh Ordinance is hereby given immediate
effect upon passas_ and approval.
