ORDINANCE NO. 166
AN ORDINANCE AUTHORIZING THE CONVEYANCE OF LOTS
31, 32 and 33, BLOCK 16 SEivARD TOWNSITE, TO RICHARD
O. SELLERS, AND ACKNOI/LEDGING FURTHER INDEBTEDNESS
Be it ordained by the Common Council of the City of Seward,
laska;
Section 1. That the City of Seward, Alaska on the 17th day of
une 1946, acquired by purchase from the FEDERAL \DRKS AGENCY, titl
to all of Lots 27, 28, 29, 30, 31, 32 and 33 in Block 16 of the
riginal Townsite of Seward, Alaska, for the total consideration of
$13,205.00.
Section 2. That at the time of making said purchase, the City f
eward was without funds, but did recognize the compelling necessit
or a larger and more convenient public building to serve as a City
all and for other municipal purposes, and did thereupon enter into
n agreement with Richard O. Sellers of Seward, Alaska, whereby it
AS specifically understood and agreed ,as follows:
(a) That Richard O. Sellers advance to the City of
Seward, Alaska, as a loan, the sum of $13,205.00 for the
purchase of all lots 27, 28, 29, 30, 31, 32 and 33 in
Block 16, together with all the buildings and improvements
situate thereon, and including all the furniture, fixtures,
and personal property of every kind and description contained
in said buildings; xa said building being heretofore used
and occupied by the USO.
(b) That in consideration 6f such loan and advance
the City of Seward, Alaska grant to said Richard O. Sellers
the exclusive use and possession of the Building situate
on the ~orth 28' of Lot 31 and all of lots 32 and 33,
Block 16, as well as all the personal property therin
contained, from and after the date of the purchase thereof
by the City of Sewara (17th June 1946).
(c) That on, or immediately after the 5th day of July
1947, the City of Seward, Alaska convey to Richard O. Sellers
his heirs and assigns, by a good and sufficient Deed, title
to the North 28' of Lot 31 and all of Lots 32 and 33 in
Block 16 of the Original Seward Alaska Townsite, as well
as title to all the furniture, fixtures, equipment and
other personal property contained in the building situate on
said lots; and that such conveyance be regarded as repay.
ment of the sum of Si~ Thousand Dollars ($6,000.00) of
said loan, with interest:
(d) That the City of Seward Alaska, in addition
to the making of such conveyance of the N28' of Lot31
and all of Lots 32 and 33 in Block 16, also repay to
Richard O. Sellers, the balance of said loan, in the
amount of $7,205.00, together with interest thereon from
the 17th June 1946 at the rate of 6% per annum, on or
before the 1st day of October 1947.
Sedtion3. That such an agreement is fair and very reasonable
and for the best interests of the people of Seward Alaska; that as
result of such transaction, purchase and agreement, the City of
Seward has acquired title to Lots 27, 28, 29, 30 and the South 2'
of Lot 31, Block 16, Original Townsite of Seward Alaska, upon whic
is situate the large Hall formerly used by the USO.

Section 4. That the Mayor and Municipal Clerk be and they are
hereby authorized to convey, on or innediately after the 5th day
of July 1947, by a good and sufficient deed, or other suitabl, and
satisfactory instruments of conveyance, title to the North 28' of
Lot 31 and all Of Lots 32 and 33 in Block 16, Original Townsite of
Seward, Alaska, to Richard O. Sellers; that such conveyance shall
be regarded as equivalent to payment1 by the City of Seward, Alask
of the sum of Six Thousand Dollars (t6,000.OO) and interest, and
shall reduce theloan and the indebtedness accordingly.
Section 5. That on or before the 1st day of October 1947, the
City of Saward, Alaska shall pay to Richard O. Sellers.the balance
of said loan, in the amKm amount of Seven Thousand Two Hupdred Fiv
Dollars ($7,205.00), together with interest thereon at the rate of
6% per annum from the 17th June 1946.
Section 6. That conveyance as specified in Section 4 hereof,
and payment as specified in Section 5 hereof, shall consitutex
complete and final discharge of the obligation of the City of
Seward, Alaska to said Richard O. Sellers and shall constitute
full and complete compliance and performance of the agreement
afresaid on the part of the City of Seward, Alaska.
