AN ORDINANCE TO PROVIDE FOR TEE lliASING OF THE SEvVARD NlARINE
,lAYS FOR A TERM OF FIFTY (50) YEARS AND TO PRESCRIBE TEE TERMS
AND CONDITIONS OF SUCH IEASE:
WHEREAS, the City of Seward, by enactment of Ordinance
No. 182, on the 1st day of March, 1948, leased to the Seward
Fish & Cold Storage Co., Inc., that certain property located
in the City of Seward and known as the Seward Marine Ways and Dock
Facilities as bounden and described in "U. S. Survey Map No.
2830 Alaska"; and
WHEREAS, by the provisions of said lease, the term thereof
was of a duration of ten (10) years, commencing on the first day
of March, 1948, and ending on the last day of February, 1958; and
WllliREAS, the lessee desires to obtain upon said premises, a
lease for the term Of fifty (50) years, and
WEEREAS, the lessee has succeeded in obtaining an agreement
with Anchorage Sand & Gravel Company of Anchorage, Alaska, where-
by said company has agreed to establish cement unloading facilities
upon the leased premises; and
WHEREAS, the installation of said facilities will result in
the establishment of a new industry which will be beneficial to
the economy of the City of Seward; and
\VHEREAS, the lessee durine the past two (2) years has en-
countered difficulty in encouraging new industries to become estab-
lished upon the premises known as the Seward Marine Ways and
Facilities because investors refused to establish facilities upon
the leased premises for terms eqlal to the term of the existing
lease held by the lessee, and
WHEREAS, the City Council of the City of Seward has examined

and approved the provisions of an agreement entered into between the
Seward Fish & Cold Storage Company, Inc., and Anchorage Sand &
Gravel Company, Inc., whereby the latter corporation will establish
upon said premises an industry beneficial to the economy of the
City of Seward; and
WHEREAS, the City Council believes that a lease for a term of
years of longer duration will promote the creation and development
of other new industries, and
vrrlEREAS, the Council believes that a lease prescribing a longer
rental term will also enable the Seward Fish & Cold Storage Company,
Inc., to expand and better develope its own business and facilities,
and
VfrIEREAS, the Seward Fish & Cold Storage Company, Inc., in con-
sideration of the granting of a new lease has agreed to a new lease
containing and prescribing the same terms and conditions contained
in the original lease, and
WHEREAS, the common council of the City of Seward has prepared
a new lease, the terms and conditions of which are satisfactory to
the said lessee, and
iVHEREAS, the C~uncil of the City of Seward deem said lease to
be favorable, advantageous and beneficial to the public interests
of the said City,
NOW THEREFORE, be it ordained by the Common Council of the
City of Seward, as follows:
Section I. That the proposed lease heretofore prepared and
this day presented to the City C0uncil of the City of Seward, a
copy of said lease being hereto attached, and by this reference
incorporated herein, be and the saree is hereby ratified and approved
in entirety.
Section II. The Mayor and the City Clerk of the City of Seward
are hereby authorized and empowered to sign said lease in their
respective official capacities and affix the seal of the City of
Seward to said lease and deliver a copy of the same to the lessee.

Section III. The Council, deeming an emergency to exist
requiring suspension of the rules governing the passage of ordi-
nances, does hereby declare an emergency to exist and does here-
by suspend the rules for the immediate passage of this ordinance,
and this ordinance shall take effect immediately on its passage
and approval.
Passed and approved this 6th day of February, 1950, by the
Common Council of the City of Seward, Alaska.
