PAYlcDINTS FOd 1'LEGT~UC SERVICE Seward, section That Section 1 of Ordinance 207 of the City of Alaska, is hereby amended by adding thereto Sub- (e) reading as follows: "Before any new business establishment or new manage- ment of an established business may be served with electric energy, the party contracting therefor shall deposit with the Seward Electric System a reasonable amount of money e\lual to the estimate of two months' bills for the service applied for, to guarantee payment for any indebtedness arising out of the servicing of said premises with utility servi ces. t1 Section 2. BE IT ORDAINED Ff THE OOH~{)N COUNCIL; of the City of Seward, Alaska: ~ SUPPLEMENT 'ID ORDINANCE NO. 207 Sec 1. The installation of wires and apparatus for carrying electric current used for furnishing light, heat or power, in all buildings hereinafter constructed in the City of Seward, shall be subject to the following rules and regulati')!ls v of the National Board of Fire Underwriters for electric wiring and apparatus, as published in the "National Electric Code" cC1rrent edition, and all materials, fittings and apparatus used for electric purposes under the provisions of these rules must be approved hy the inspector unless specified in the list of approved elec- trical fittings published by the rTational Board of Fire Underwriters and kept on file in the office of the City Clerk of the City of Seward. These rules shall also apnly in all buildings in which repairs and alterations are made." Sec 2. Any person, firm or corporation installin~ any new electrical wiring, fittings, fixtures, appliances, apparatus or other electrical devices or making changes in or additions to present equipment or any existing electrical equipment, is hereby required to obtain a permit from the City Clerk of the City of Seward. Said permit shall state' the location (Block and Lot No.) of the building or struc- ture, the person, firm or corporation makin~ such installation and all other data and information that may be prescribed by the electrical ihspector. Said permit shall not be transferable. The City Clerk may refuse to issue any permit to any peron, firm, or corporation, or owner of any building or structure who may have neglected, refused, or failed to comply with the provisions of this Ordinance. As hereinbefore provided, a permit shall be o~tained for all electrical work, pro- vided, however, that when the total cost of repairing old installation only, in- cluding time and material used or consumed, does not exceed Five (5.00) Dollars, no fee shall be charged for such permit. The City Clerk is hereby given the authority to refuse to issue any permit to do any construction or repairing of any electric wiring ~ystem or equipment in or on any building or other structure, when in the opinion of the electrical inspector the electric wiring or equipment is not safe to life, or property, or does not comply with the provisions of this Ordinance. In order to procure a permit for the installation of electric wiring or fixtures, fittings, apparatus and appliances used for light, heat, or power for making alterations in or additions to present equipment of any existigg electrical in- stallation, the person, firm, or corporation applying for and receiving such permit shall pay the City Clerk the sum of One (1.00) Dollar except as hereinbefore pro- vided . The fee hereinbefore provided shall inClude not more than two inspections and all additional inspections or re-inspections shall be charged for at the rate of twenty- five (25~) cents. In case a person, firm, or corporation takes out a permit to do the "roughing in wiring" of any building or structure, he or they will be allowed to install all fixtures thereof without extra fee, but when the fixtures are installed by a person, firm, or corporation other than the installers of the "roughing in wiring" a sep- arate permit must be obtained and a fee paid as hereinbefore provided. Sec. 3 Inspection: building, structures on which such wiring reasonable hours. The electrical inspector shall have access at all times to any or premises, in or on which any wiring is being done, or in or has been done; provided that sucp inspection shall be made at I The electrical inspector shall be deemed the sole judge of what constitutes the proper installation and safe insulation of electrical tonductors and appliances within buildings. He shall decide all questions not provided for in this ordinance, pertaining to the installation of electric conductors and appliances, and he is hereby authorized to make such rules and regulations as may be deemed necessary to make conductors and appliances as safe as possible. It shall be unlawful for anyone to hinder or interfere with the electrical in- spector of the City of Seward in the discharge of his duties. . . Any person, firm, or corporation shall, on the Gompletion of any electrical work covered by any permit 50 to do, notify the City Clerk in writing that such electrical work is ready to inspect. On inspection of any electric wiring, if found to comply with all the proVJ.s~ons of this ordinance, a tag shall be placed at the service, or any other oonspicious place, but if the wiring is found to be defective, incomplete or otherwise not complying with the provisions of this ordinance, the person, firm, or corporation doing such work will be notified to change same to conform to rules of this orMnanee. All tags or lables shall bear the signature of the inspector and the date of inspection. No electric current shall be turned on or connections made for use until final in- spection has been made and a certificate of approval is issued; provided the elec- trical inspector may issue a temporary permit for use of eledtrical current during course of construction or alterations of any buildings or other structures, said permit shall automatically expire when the work is completed as covered under permit or permits, or when the work and materials are not being installed in conformity with requirements of this ordinance. On completion of any work c overed by any permit 50 to do, and in accordance with all the provisions of this ordinance, the electrical inspector shall issue a certificate of inspection. No person shall lath or otherwise cover from view any wiring that has not been ac- cepted by the electrical inspector. 8ec.4. It shall be unlawful for any owner, tenant, firm, person, corporation or workman not holding a permit for doing electrical work to cut, damage, interfere, made additions to, or alterations in any wiring, fixtures, fittings, etc. that have been accepted by the electrical inspector. In case of emergency that eledtrical inspector should be notified and a temporary permit issued. NATIONAL ELECTRIC CODE: Adoption of: The rules governing the installation of electrical wiring apparatus and use of electricity in the City of Seward, which are hereby approved by the City Council of the City of Seward, shall be known as the latest current editing of the NATIONAL ELECTRICAL CODE published by the NATIONAL OOARD OF FIRE UNDERWRITERS together with the special rules made from time to time. Sec. 5 It shall be unlawful for any person, firm or corporation, as owner, tenant, architect, contractor, or artisan, or otherwise, to do or cause to be done any electrical wiring or installing of any electrical fixtures, fittings apparatus or other device for the use of transmission or consumption of electric current for light, heat, or power in such manner that the same shall not conform to all the requirements of the NATIONAL ELECTRICAL CODE, special rules and other provisions of this ordinance. Penalties: This ordinance shall not be construed to relieve or lessen the respon- sibility of any persons or person, co-partnership, or corporation, owning, operating or installing any electrical wires, appliances, apparatur, construction or equip- ment fotthe damage to any property or injury to any person by defects therein; no~ shall the City of Seward or any agent thereof, be held as assuming any such liability by reason of inspection 'authorized herein, or the certificate of inspec- tion issued by the electrical inspector. No person, firm or corporation shall install, or repair, or ~ssist in installing or repairing any elel'rtcal wiring, fittings, fixtures, appliances, apparatus or other electrical devices, or make or assist in making any changes in or addition to present equipment or any existing electrical e~uipment, without first having obtained a license therefor, after examination by an official to be hereinafter designated by the Council, which said license shall be for the period of one year, from July 1st to June 30th of the following year. Such license shall be signed by the Clerk of City of Sevlard, and shall contain the name of the person t,) whom issued, with 8 statement therein that the LiceJ'1see named therein is qualified and pemitted to do electrical work in the City of Seward. The person to whom such license is issued shall pay therefor thE' sum of Twenty-Five ($25.00) to said r.ity Clerk. r-- "The licensee sha.ll fur-nisb a cash or surety bond to the City of Seward, in the penal sum of $500.00, to be approved by the Common Council of the City of Seward, the conditions of which said bond shall be that the licensee will "c"f perform all electrical work undertaken ty hjm within the City of Seward, in accordance with all specifications, ~lles, regulations, and pr8visions of this Ordinance, and amendments thereto, anJ <.:11 other laws of the City of Seward re- lating to installation, alteration, and repair of electric wiring, fittings, fixtures, apparatus and appliances. Surety bonds other than those executed by corporate E sureties authorized to do business within the Territory of Alaska, shall be signed by two or more individual sureties owning property within the City of Seward, subject to execution, and who, taken topether, are worth more than ~500.00 over and above all debts, lia'rilitics and exenlppicbns." PHASE - - - FREJ.UENGY- - - - VOLTAGE Sec 6 The electric energy to be supplied by the City of Seward shall be of the phase, frequency and ch~acter of the ener~y carried by the City's distribution lines nearest to the consumer's premises and shall be delivered at a voltage which is standard with the City. lfET":RS - - - - H'STAlI ATION- - - - - - REt\DING Sec 7 All energy delivered by the City shall, except as hereinafter otherwise provided by the City in some convenient place approved by the Cjty upon the con- sumer's premises and at or near the point where energy shall be delivered to the cons~er, which point of delivery shall be subject to the City's apnroval. Con- necting wires from service to meter and meter to load shall be run in approved metal onduit and fittings. The readings of each meter installed shall be deemed oon- elusive as to the quantity of energy delivered through it, unless upon b~ing test- ed, such meter shall be found to register inaccurately and its inaccuracy shall ex- ceed two per cent. In every case where these inaccuracies shall be more than two per cent, but nevertheless, can be approximately determined, the readings of such meters shall be corrected, but in al] other cases where the inaccuracy of any in- stalled meter shall, during an~r periOd of time, for any reElson whatsoever, exceed two percent, the amount of energy delivered through such meter during such period- shall be estimated by the City according to the rated capacity of the electrical apparatus used by the consUJb.er during such period of time and supplied with energy through ~lch meter, and the consumer's average daily conSUMption of energy per unit of rated capacity of such electrical apparatus or so much thereof as was in use dur- ing the last preceding calendar mont;. But no corrections for inaccuracies of meter measurements shall be made in any bill rendered by the City unless the party com- plaining of such inaccuracy shall, in writing request such correction within thirty days after the rendition of such bill. MET'rnS, WIRES, ETC. PROPERTY OF CITY Sec 8 All meters and electrical wires, appliances, apparatus and fixtures of every discription installed by the City uron the consumer's premises for the purpose of delivering electric energy to the consumer shall continue to be the property of the City and may be repaired, replaced or renewed by it at any time. No-rent or other charge what so ever shall be made by the consumer against the City f~r placing or maintaining said meters, wires, appliances, apparatus or fixtures upon the consumer's premises. All meters shall b~ sealed with the seal of the City and no such seal shall be removed, tampered with, or be broken except by representatives of the City appointed for that purpose. The eonsumer shall exercise reasonable care to prevent the meters, appliances, apparatur, and fixtures of the City upon said premises from being injured or destroyed and shaH refrain from interfering with the same and in case defect therein shall be discovered, shall immediately notify the City thereof. CITY'S RIGHT OF INGRFSS Tn CmrSUMERS PlZF1.fISES. Sec 9 The City shall at all times have the right of ingress to and egress from the co~r's said premises for any and all purposes reasonable connected with the furnishing of the electricity and the exercise of any and all rights secured to it by the law or the rules and regulations. ~ -CONSUMER RESPONSIBLE FOR E:/.UIPMENT FOR CONSUMING ENERGY Sec. 10 The consumer shall at his own risk and expense, furnish, install, and keep in good and safe condition all electrical wires, lines, machinery, and apparatus which may be required for receiving electric energy from the City and for applying and utilizing such energy, and shall indemnify the City against any and all loss, damage, and liability, including liability to third persons, occasioned or caused by any de- fects in the condition or construction of such wires, lines, machinery and apparatur, or any part thereof, or by reason of any negligence on the part of the consumer in installing, maintaining, using or operating such wires, lines, machinery or apparatus. ~ISCONTINUANCE OF SERVICE TO UNSAFE APPARATUS Sec 11 If any part of the consumer's electrical wires, lines, machinery, or apparatus shall at any time be unsafe the City shall have the right, to be exercised at its option, of ceasing to deliver energy until the consumer shall put such part in good and safe condition and comply with all laws, ordinances, and regulations applicable thereto. The City assumes the duty of inspecting the consumers electrical wire lines, machinery, or apparatus, or any part thereof. In the event that electrical service to the consumer is defective, the consumer shall immediately notify the City of that fact. SHORTAGE OF EIFCTRIf; F,~TF,1tGY SUPPLY See 12 I!,odue to inevitable accident, act of God, fire, strikes, riots, war or any other act beyone its control, the city shall not have sufficient electric ener- gy to supply all of its consumers with the fllll amount required by such consumers, city shall have the right to give preference in the matter of furnishing electric energy to the City of Seiard, the Alaska Railroad, and the United states or its agencies, to the Territory of Alaska, and to other public or quasi-public service. SERVICR INTFRRUPTIONS Sec 12 The city shall exercise reasonable intelligence and care to furnish a nd deliver electric energy to the cons'Jmer and to avoid interruption of delivery of such energy, but nevertheless, shall not be liable to the consumer for any loss or da~ge which may be occasioned to the latter by any failure on the part of the city so to deliver such energy or by an interruption in delivery of such energy or by any loss or damage which may be occasioned by energy delivered by it, if such failure, interruption, variation, riots, war or any other cause except its own voluntary act of ommission or it neglects to exercise reasonable care and dili- gence. The city, moreover, whenever it shall find it necessary for the purpose of making repairs upon, or improvements in any part of its electric generating and energy, but in all such cases such reasona~le notice thereof as circumstances will permit, shall be given to the consumer and the making of such repairs or improve- ments shall be prosecuted as rapidly as may be practicable, at such times as will cause the least inconvenience to the customer. REX::EIPT FOR DEPOSIT _/HID APPI.ICATION FOR SERVICE Sec 13 When a consumer shall have paid the deposit required , a receipt shall be issued to him for such payment. Such receipt shall contain name and location of the consumer's premises. And said applicant shall agree thereon to pa~r for the electrical energy or service delivered to him pursuant to his said application and in accordance with the city's schedules of rates from time to time enacted and enforced, and to abide by the terms of this and other ordinances of said city, and to comply with the city's rules and regulations from time to time enacted and in force. USAGE OF SERVICF. DETRIMENTAL TO SERVICE 8F OTHER CONSUMERS Sec 14 The city shall not be required to furnish electricity for the operation of any electrical apparatus or appliances, the operation of which will be de- trimental to the electric service being furnished by the city to its other con- sumers or supplied from the same distribution system, and the city shal~ have the right to discontinue furnishing electricity to any consumer who shall after being notified by the city to discontinue using electridity for the operation of such electrical anrliance and apparatus, continue to so use the same. r NOTICE TO DISCO~~I}ruE SERVICE Sec 15 Each consuwer, about to vacate any premises supplied with service by the city shall give written notice of his intended removal at least three days prior thereto, specifying the date of such intended removal. Otherwise he will be held responsible for all electricity furnished to such premises, until the city shall have notice of such removal and have had the opportunity to disconnect the meter. RELEASE OF EI,Ex::TRICAI, ENERGY Sec 16. The consumer shall have no right to assign any application made by him or any of his rights there unto nor to use the electric energy delivered to him at any other place than the premises specified in said application or for any purpose other than the purpose specified in such application. SUPPLY TO SEPARATE PREMISES THROUGH SEPARATE METERS Sec 17 In no event will separate premises, even though owned by the same con- sumer be supplied with electricity through the same meter or meters. SERVICE CONNFCTIIJNS MADE BY CITY EHPIDYEES Sec. 18 Only duly authorized employees of the city are allowed to connect the consumer's wiring with the city's electric line. READD\rm5 OF SF.J>ARATE METEF.5 NOT COMBINF.D Sec. 19 For the purpose of making charges all meters upon the consumers premises shall be considered separately and the readings thereof shall not be compined, except that where the city shall, for operating convenience, install upon the consumer's premises, in place of one meter, two or more meters, than the readings of such two or more meters shall be combined for the purpose of making charges. RATES Sec 20 The rates to be charged by and paid to the city for electric energy and service shall be the rates from time to time established and enforced and in accordance with its schedule of rates from time to time in effect. cmPLIANCE WITH RULES See 21 If the consumer shall fail to comply with any of the city's rules or regulations from time to time in force, the city shall have the right forthwith to discontinue service to the consumer. AGENTS OR EMPIOYF,ES CANNOT CHANGE RUI.ES See 22 No inspector, collector, agent or employee of the city has any authority to waive, change or ammend in any respect these rules or regulations or any part thereof. PERSONAL COHPEl\ISATION NOT BE GIVEN TO THE CITY'S AGEJlITS OR El>fPIDYEES Sec 23 All inspectors, agents, and employees of the city are strictly forbidden to demand or accept any personal compensation for services rendered, from consumers or others save the city. Any person, firm or corporation violating any of the pro~s~ons of this Ordinance shall be deemed guilty of a misdeamor, and upon conviction thereof shall be punished by a fine of not more than one hundred dollars, and each day's continuance thereof saall be construed to be a separate offense. r ~ ~ ~ ~ c.; f$ € , , ,....... ~, I vlL'tING CODE ~o~ ,fe't: ~ (A) SERVICES: 1. CJry OJ;' S'" ~ 11'-<4.tb r EL~TRICAL RFnULATIONS Reg. 1 ELEX:TRICAL CONTRACTORS All meter bases must be furnished by the customer. Par. (a) In all new wiring, C. S. type meter bases must be installed. Bases must not be over seven feet from the ground floor nor less than five feet from same. Bases must be separated three inches both horizontally and vertically from each other or switch boxes or gutters. Conduit extending from bases on outside wail through to inside wall shall be plugged wit~ some flame resistant material to pre- vent moisture from condensing inside the meter in cold weather. Par. (b) vmere practical meter bases shall be placed outside in an accessible location. Par. (c) The practice of making service connections or shunting through meter loops to give timporary service is prohibited by ordinance, in case this service is desired call the City Electrical Superintendent. Reg. 2 S:<:rVICE EHTRAECE Cm'DUCTORS Par. (a) In all? wire services where one wire is the neutral or grounded conductor, the neutral conductor shall be connected to the upper right hand terminal of the meter base. Par. (b) Water heater service switches shall break both conductors of the circuit. Par. (c) All interior wiring systems except polJrphase s;;.sterns shall have a proumed conductor which is continuously identified throu?hout the system and so connected to the identified terminals of all devices in the s;;.stem. Par. (d) Rubber covered neutral conductors of No.6 or smaller shall have identifying out covering of white or gray. Gro1mded conctuctors larger than No.6 shall be identified by painting the exposed conductor white or gray. Par. (e) The use of armored cable kno'~ to the trude as F.X. is not allowed. In cases where flexabili ty is desired s'lch as motor connections, flexible conduit known to the trade as, "Greenfield", may be used provided it does not exceed three (3) feet, and suitable fittings are used. Reg. 3 R:Fr:'ti1'TACL'S CIRCUIT:'" n: DHELlINGS Par. (a) In dwellings, branch circuits for receptacle outlets shall not supply more than 6 receptacle outlets and shall be independent of lighting outlets. In commercial bldgs. receptacle branch circuits shall supply a maximum of 4 receptacle outlets, and shall be independent of lighting outlets. No branch circuits which supply receptacle outlets in any bldg. shall have conductors smaller than /112. Reg. 4 UNGROUNDED FIXTURES Par. (a) Ungrounded lighting fixtures, lamp holders and receptacles including face plates, shall not be installed within reach of bath tubs and shower tubs. Par. (b) Such fixtures and l&~p holders shall not be within reach of plumbing fixtures, steam pining or other grouncted metal work of the premises. !,fetal pull chains used at these locations shall be provided with insulating links, wall switches are preferable to pull chains. Reg. 5 FIRE Z01'E.S AND HAZARDOUS lOCATIONS Par. (a) Connections to motors and fans that are used in connections with furnaces, ranges, etc, in commercial establishments shall be wired in accordance with the requirements of the Code of hazardous locations (Article 500, Classl, Group D) Par. (b) Public buildings outside the FIRE ZO~~ and public garages of more than one car capacity shall be wired in conduit. Par. (c) Buildings ~ons~~t~ng of more than one apartment shall be wired in conduit. Par. (d) All buildings in which gasoline, oil and other inflammable substances are kept shalJ_ be wired in accordance with National requirements for hazardous locations. Reg. 6 par. (a) All service entrance condutors shall be installed in rigid conduit and the conductors shall be inaccessible to unauthorized perenns. Par. (b) AJl service entrance cond'lctors must be run through meters before entering load distribution cabinets or panels. Metered and unmetered, 01: fused and unfused c0nductors shall not be in the same conduit. Reg. 7 Par. (a) If two or more meters are installed adjacent to each other in the same building and fed from one set of service entrance conductors, the use of bus gutters , other gutters or raceways is permitted, provided that bus gutters, other gutters, or raceways are of rain tight construction, can be sealed, and are approved by the City Electrical Su~erintendents office. Reg. ~ Par. (a) Master switches may be installed only wit~ the approval of the Electrical Superintendents office. (a) For acceptance by the City Inspection Dept. the weather head must be at the nearest point to the pole that will serve the building, except where observance of this rule will bring the service UWier the eaves or will incorporate some other undesirable feature, whicp would cause a hazard or place an obstruction in the path of the service wires from the pole to the building. Par. (b) Point of attachment for service wires shall not be less than 10' (ten feet ) from ground level. Par. (c) 'Vhere Buildings are located on customer's property so as to cause what may be termed as obstructions or hazards to service drops, steps shall be taken by the customer to install underground service or erect a structure or pole to facilitate installation and maintenance of said drops. lVhere any doubt exists the type of construction shall be determined by the City Inspection Department. Reg. 11 Par. (a) Meters must be readily accessible at all times. Par. (b) No oil barrels, oil storage tanks, structures or obstructions of any kind may be installed on amy premises in any manner that will render the meter or meters inacessible or hamper any City employee in the fulfilment of his duties. Reg. 12 Par. (a) City power line poles must be kept accessible at all times. Par. (b) No ash cans, garbage cans, paper cartons, wooden boxes, or crates, or other refuse of any kind may be placed nearer than ten (10) feet from the base of any city power line pole. Par. (c) No radio antenna, clothes line, fence, or other wire or device may be attached to any City power line pole without the consent of the Electrical Superintendent or his duly authorized representative. r Reg. l~ Par. (a) 3 wire service shall be not less than #6 A.W.G. and shall be installed in not less than It" rigid conduit. Reg. 14 Par. (a) Reg. 15 Meter sealing rings shall be furnished with all meter bases. Par. (a) All temporary services shall have parts on load side of meter such as switches, convenience outlets, etc., protected against weather if not of weatherproof construction. Ground rods on these s~rvices may con- sist of ~II conduit or similar material. Ground wires are to be pro- tected by conduit against mechanical injury. Reg. 16 Par. (a) A ground outside of building shall be provided for all servides housed inside of building where inside ground is not practical in the opinion of the inspector. Reg. 17 par. (a) No permanent meter shall be installed until the meter loop is complete, all wire in place and all joints soldered and taped. Reg. 20 Par. (a) The use of combination load centers for water heater and building service will be discontinued. A separate enclosed circuit breaker for water heaters will be installed in a11 cases. The use of combination load centers makes possible the use of jiuce at water heater rates for building service by merely installing two jumpers. An emergency is hereby declared to exist and this Ordinance shall be in full farce and effect immediately after its passage and approval.
