CITY OF SEWARD, ALASKA
ORDINANCE 99 -16
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING SEWARD CITY CODE TITLE 15 PLANNING AND
ZONING RELATING TO CODE ABATEMENT NOTIFICATION, CON-
FLICTING CODE PROVISIONS, DEFINITIONS, PARKING REGULA-
TIONS AND HARBOR BUILDING HEIGHT DEVELOPMENT REQUIRE-
MENTS
WHEREAS, it is in the public interest to maintain a city code that is up to date and in tune
with current community needs.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD, ALASKA
HEREBY ORDAINS that:
Section 1. Seward City Code Title 15 Planning and zoning ehapter 15.01. General
Provisions, Section 15.01. 050 Enforcement and penalties A. Procedures for abating violations.
is hereby amended to read as follows:
1. When a violation is discovered, the "ily l111\ua8,,1 01 1';5 dc,si8I1CC, administrative official
shall notifY in writing, via certified mail or personal delivery with proof of receipt or by notice posted
at the site ofthe violation, the person responsible for or the owner of the property upon which said
violation occurs. The notice shall specifY the violation and order abatement within a reasonable
period oftime, to be no longer than ninety days. Interpretation and abatement action of all purported
violations known to the city lIlallagc,1 administrative official shall be presented to the commission at
its next regular meeting.
Section 2. Chapter 15.05 Land Use Planning, Section 15.05.030 Parks development
and improvements. " All pabli(, park. developments and improvements to city-owned park facilities
shall require the prior approval of the city Parks and Recreation Director." is moved in its entirety
to Chapter 7 Campground, Parks and Open Spaces and renumbered as Section 7.15.025
Section 3. Seward City Code Title 15 Planning and Zoning Chapter 15.10 Seward
Zoning Code Article 1. General Provisions is hereby amended to read:
Section 15.10.135 Conflicts between codes Whenever there is a conflict between within this chapter
or with other ordinances pertaining to regulation of property within the city, the most restrictive
regulation shall apply.

Section 15.10.140 Definitions B. Specific definitions........
Lot, buildable or useable area. That portion of a lot that a prudent person would use to
construct a building and provide required parking. This excludes lakes and rivers, creeks, cliffs,
marshes and other similar natural obstacles to development with the property counting toward
minimum required size. .......

Section 5. Seward Cit.y eode Title 15 Planning and Zoning Chapter 15.20 Signs IS

Section 15.20.015 Definitions.
Sign, Sandwich board (also V-Shaped) Signs erected upon common or separate structures
which present a V -shape appearance and having an exterior angle between faces of not more than
forty-five (45) degrees with a distance between faces of such signs at their closest point not exceeding
two (2) feet.
Section 15.20.040 Sign standards by zoning district which require permits. ....
D. Harbor commercial district.
1. Combined square footage of signs shall not exceed one square foot per lineal foot of
property fronting: (a) street; (b) the harbor basin; ( c) the public boardwalk; (d) where a building faces
toward a street but does not abut it, or (e) a public parking lot, to a maximum of two hundred square
feet per frontage.
2. At the discretion of the property owner, any portion ofa property's total allowed signage
may be allocated to the sides or rear of the lot not fronting l(a)...(e) above so long as it does not

Section 6. This ordinance shall take effect ten (10) days following its enactment.
