ORDINANCE 2000-13
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA, AMENDING THE SEWARD CITY CODE, CHAPTER 2.30,
BOARDS AND COMMISSIONS, ALLOWING FOR DIRECT COUNCIL
APPOINTMENTS OF BOARD AND COMMISSION MEMBERS BY
DELETING THE CODE PROCEDURE REQUIRING THE MAYOR TO
FIRST NOMINATE CANDIDATES FOR APPOINTMENT
WHEREAS, the Seward City Code requires appointments to the Seward Planning and
Zoning Commission, Port and Commerce Advisory Board, and the Historic Preservation
Commission to be first nominated by the Mayor; and
WHEREAS, subsequent to adoption of these code sections, Rule 38 of the Rules of
Council Procedure outlines a council balloting process as the method to choose board and
commission appointments; and
WHEREAS, when there is a conflict between the City Code and the Rules of Council
Procedure, the City Code would prevail; and
WHEREAS, the City Council, as shown by adoption of the Rules of Council Procedures,
desires to eliminate the Mayor nomination process and follow a ballot appointment process; and
WHEREAS, to eliminate confusion concerning the method of council appointment to
Boards and Commissions it is desirable to amend the City Code to reflect the Council's intent as
evidenced by the Rules of Council Procedure;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEWARD,
ALASKA HEREBY ORDAINS that:

Section 1. Chapter 2.30 of the Seward City Code, Boards and Commission, Article 2,
pertaining to the Seward Planning and Zoning Commission is amended to read as follows:

2.30.210 Established.
A. There is created the Seward planning and zoning commission, consisting of seven
citizens, all of whom shall reside in the city and who shall be nonlinatcd by th", IlllryOI and
confilltled appointed by the council. If there is more than one applicant for the position, the
Council shall appoint by ballot voting. Applicants must receive at least four votes in order
to be appointed. No officer or employee of the city may be an appointed member of the
commission.
B. A chairman ofthe commission shall be selected annually and shall be appointed
from and by the appointed members. (Ord. 471, 1979; Ord. 479, 1979; Ord. 492, 1980; Ord 626,

2.30.215 Terms of office; filling vacancies.
A. Members of the Seward planning and zoning commission shall be appointed for
three years; provided that the terms of initial appointments shall be staggered so that as nearly as
possible a pro rata number of members shall be appointed each year.
B. The mayOI, witl. al'Plo.al oft The council may appoint any qualified person to fill
a vacancy of any member of the commission; provided, that the appointment shall be for the
unexpired term of the vacancy.
C. Following a member's absence from three consecutive regular meetings of the
commission, the remaining commission members shall decide whether the commissioner should be
retained or whether to request council appointment of a new member. (Ord. 492, 1980; Ord. 626,

Section 2. Chapter 2.30 of the Seward City Code, Boards and Commission, Article 3,
pertaining to the Port and Commerce Advisory Board is amended to read as follows:
2.30.310 Established.
A. The port and commerce advisory board is hereby created, consisting of nine
residents ofthe City of Seward or surrounding areas, and who shall be nOJllinatcd by the IlllryOJ

the Council shall appoint by ballot voting. Applicants must receive at least four votes in
order to be appointed. No officer or employee of.the city may be appointed a member of the
board.
B. A chainnan of the board shall be selected annually by the appointed members.
C. The city manager will appoint a city employee to serve as an ex officio member of
the board who shall have the privilege of the floor but not the right to vote. (Ord. 512, 1982;

A. Members of the port and commerce advisory board shall be appointed for a term
of three years; provided, that the terms of initial appointments shall be staggered so that as nearly

D. Members shall not be paid for services on the board or participation in board

Section 3. Chapter 2.30 of the Seward City Code, Boards and Commission, Article 4,
pertaining to the Historic Preservation Commission is amended to read as follows:
2.30.410 Established.
A. An historic preservation commission is hereby created, consisting of seven
residents of the city of Seward or surrounding areas, who shall be nominated by the. mayOl and
eOllfiI lHed appointed by the council. If there is more than one applicant for the position, the
Council shall appoint by ballot voting. Applicants must receive at least four votes in order
to be appointed. No officer or employee of the city may be appointed a member of the
commISSIOn.
B. To the extent available in the community, three commission members shall be
professionals, as defined in Appendix A of36CFR 61, from the disciplines of history, architecture
or architectural history and archaeology. If the commissioners are not professionals in the
disciplines of history, architecture or architectural history, and archaeology, then consultants in
these disciplines will be appointed as consultants to the historic preservation commission.
Consultant appointments shall be approved by the historic preservation commission and must be
qualified under the standards defined in Appendix A of 3 6 CFR 61.
C. A chairman of the commission shall be selected annually by the appointed

Section 4. This ordinance shall take effect ten (10) days following its enactment.
